Die Erteilungsvoraussetzungen des § 25 Abs. 5 AufenthG liegen nicht vor. Eine Unmöglichkeit der Ausreise im Sinne des $ 25 Abs. 5 AufenthG im Hinblick auf die Schutzpflichten der Art. 6 GG und Art. 8 EMRK kann nur dann angenommen wer- den, wenn die familiäre Lebensgemeinschaft nur im Bundesgebiet gelebt werden kann. Denn Art. 6 Abs. 1 und 2 GG gewähren keinen unmittelbaren Aufenthaitsan- spruch, sondern verpflichten die Behörden lediglich, bei der Entscheidung über ein Aufenthaltsbegehren die bestehenden Bindungen zu Personen, die ein Aufenthalts- recht im Bundesgebiet besitzen, zu berücksichtigen. Die Pflicht des Staates zum Schutz der Familie drängt einwanderungspolitische Belange erst dann zurück, wenn die Familiengemeinschaft nur im Bundesgebiet gelebt werden kann (vgl. BVerwG, Ur- teil vom 30.07.2013 - 1C 15.12). Es ist da- von auszugehen, dass es der gesamten Familie möglich und zumutbar ist, die famili- äre Lebensgemeinschaft in Nigeria weiterzuführen. Anhaltspunkte, die eine andere Beurteilung rechtfertigen würden, sind weder vorgetragen noch ersichtlich. Vor die- sem Hintergrund scheidet die Erteilung der begehrten Aufenthaltserlaubnis in Erman- gelung eines Ausreisehindernisses aus.

Welcome back to the Wefugees Community and thank you for reaching out to us again.

As your request here is actually still related to your last post and also to your initially opened thread, I just want to remind you of the comment function in order to react to contributions or to give updates. This will help us to keep a better overview and information in one place.

As you mentioned already before, unfortunately your application for a residence permit according to §25 (5) of the German Residence Act  got rejected. They explain in your quoted text, that you and your family may also live together in Nigeria and that Germany is not the only option to be united. As we know only very little about your personal background, it is hardly possible to give you any profound and reliable advice on your next steps here. Since I am not able to tell if there are still options for legal steps, or you should focus on doing your best in shaping your future while holding a Duldung, I would highly recommend you to get some individual support. I think I recommended this already before, right? Did you try to get in contact with a migration counselling office or did you talk to a lawyer (after getting a so-called "Beratungshilfeschein" from your local administraticve court, for instance)?

Please don't hesitate to get back to us and let us know if you need support in finding such services. We are happy to do some research as well.

What kind of residence does the mother of your child hold?
Is it 25.3?
But with humanitarian residences some states e.g Nidersachsen or Bremen issues 25.5 some states apply vgl. BVerwG, Ur- teil vom 30.07.2013 - 1C 15.12) open the court rulling n read in details.
If the mother of the kid holds residence 28.3 then you can easily get residence permit 25.5 or 36.2 otherwise it depends from city to city.
