Hello dears,

Recently i have completed my Vocational training (With Duldung), now i am holding a residence permit for 2 years accourding to section §18a.

Last week i came to know from foreigners Authority (Ausländerbehörde) that to have a permanent residence permit with an Ausbildung, an individual person must have to hold a residence permit at least for 5 years. But with a university degree this timeline is limited to 2 years (§18b).

Now coming to the point, as per my knowledge there is a new "Specialist Immigration Act (Fachkräfteeinwanderungsgesetzes)" law going into effect in march 2020. This new law is designed to give foreigners from outside the EU  an chance to live and work in Germany. If i am not wrong, there is also a section which gives a foreigner with an Ausbildung (In Germany) an opportunity to have a permanent residence after 2 years same as with an University degree?

I would really apprecite your answer and informations!

Have a nice day!

Hello @Tosin, As per my knowledge, once you meet all the requirements it would usually take 3-6 weeks for the Auslanderbehörde to issue a residence permit. All the best to you!

Dear Smile,

thank you for sharing of your question in the community.

You are really good informed, thats why I would like to complete as follows

    you must have:
    - an acknowledged qualification
    - an employment contract for employment subject to social insurance with at least 35 hours of work per week
    - full livelihood security through your own work
    - good knowledge of German in language level B1
    - you have to make a living themselves while looking for a job.

As an answer your second question I send you the folllowing explanation:

In the future, specialists will be able to settle permanently in Germany if they have had a residence permit for 4 years, work in a job corresponding to their qualification and have paid into the pension fund for at least 4 years. For specialists who have completed vocational training or a degree in Germany, the deadline is only 2 years. (https://***.diakonie.de/wissen-kompakt/fachkraefteeinwanderungsgesetz/)

But I would note, that every decision of the immigration authority has a reason, that´s why you need to adjust yourself after these decisions.

But I hope, that this answers can help your to get the goal you hope for.

Kind regards

Thank you @mbe-on_Zsigó for your answer. Just a further query, can i visit other countries including mine with this residence permit (§18a)?
Hello Smile,

you can move freely within Germany; you can only travel in and through the European Union if you meet certain entry requirements. For example, you must have a valid travel document or, if required, a visa. You can then stay in the EU for three months - each within a period of six months - without a special residence permit, but only if you do not start work there.
