I got a Yellow paper with my Asylum number and It says "Notification of the deposit of a document to be served." I attempted to deliver it on September 11, 2025, but I wasn't home, so I haven't seen it yet. I was in the process of moving and haven't yet finished moving my belongings from my Asylheim to the normal new apartment.

Thing is, I am doing a schulische Ausbildung and I notified Ausländerbehörde in February. I called Bamf and told them everything and they told me to send them a mail with my Mietvertrag and everything and tell them I didnt get the letter and they will resend it to me. They also dont know if i got a rejection or an approval or something else.
My issue is, what happens if i got a rejection? Will the deadline restart when they resend the letter?  Today is 24.11.2025 and I found out about everything today and contacted everyone I can
Will I be facing deportation even if I miss the deadlines? Like I said, Ausländerbehörde already knows about my Ausbildung. Will I be issued an Ausbildungsduldung? I couldnt call them as today is Wednesday. Lady on the phone from Bamf told me not to worry abd explain everything in Email and I did.
I didnt report my address as soon as I was moving out because my Social Worker advised so. I deeply regret it. But now Bamf knows the new address and when I moved in

If the letter was a rejection of your asylum case, then in general a person has 7 days to appeal this decision. The seven day period starts from when the letter was delivered to your place of residence. If you only received the letter in person later, the deadline stays the same.

There is an administrative procedure a person can do to have such a deadline changed if they missed the deadline through no fault of their own. This is called ‚Wiedereinsetzung‘ and you can read the legal basis for this in German here:

If you did not inform BAMF about your new address, I do not see such an application have a chance of success.

I do not fully understand what BAMF has now said they are sending you. As I understand it, the decision has been issued and sent to you and BAMF has confirmation that it was delivered to your known place of residence. While they can send you another copy of the decision, this does not change the date it was delivered to you. If possible, you should get the original letter from the Asylheim. You should also check the second letter they are sending to see whether it is a copy of the initial one (in German ‚Zweitschrift‘).

In the case of a standard asylum rejection, a person is given a deadline of 30 days to leave the country. After this point, the Ausländerbehörde can arrange for a deportation. Here is official information from BAMF:

It’s good you have informed them of your Ausbildung. In addition to the Ausbildungsduldung, a person doing an Ausbildung whose asylum case is rejected can get the regular residence permit 16g. You must still make a written application for either an Ausbildungsduldung and/or the residence permit 16g with the Ausländerbehörde. You mention phoning authorities and writing emails. While this is good to keep them updated, it is essential that you submit a written application. A phone call with an authority where a person told you ‘not to worry’ is no replacement for an application in writing, signed by you and sent with the necessary additional documents. In the worst case scenario, the authorities can say you never applied for anything after having your asylum case rejected and threaten you with deportation. Emails and phone calls you had in the past will not change this. If you need help writing an application, a migration advisory service in your area can assist you free of charge. Whether you can get an Ausbildungsduldung or the residence permit 16g depends on whether your identity has been clarified and if you are financially secure. If so, then you can get the permit 16g. To be considered financially secure, you have to have 666 euros per month. With the permit 16g you are allowed to work 20 hours a week in addition to your Ausbildung. Otherwise you can get an Ausbildungsduldung and get financial support from the Sozialamt.

Hi Eanna,
Ausländerbehörde looked up the type of rejection it was and told me i had 14 days after the 11.09.2025 to file and objection and luckily i managed to file an objection. She told me that I was lucky it wasnt 7 days because it wasnt offensichtlich unbegründet, but just unbegründet. My lawyer said the same thing. Is it really 7 days? Everywhere else says 14 days. And my lawyer said it reached the court on the same day of objection because he did it via an online portal.
The address on the yellow paper for the post office was also incorrect because they made a mispelling with the street name. Like instead of writing Freiburgerstraße they wrote Friberger. My lawyer also added that in the appeal, just in case i missed the deadline but he told me i didnt
I called Ausländerbehörde and they told me i need to be on duldung first to get ausbildungsduldung. And that i probably wont be on that bc my lawyer filed an appeal. Is that right?

Different deadlines apply to the various types of asylum rejection: For a "simple rejection," the appeal must be received by the competent administrative court within two weeks. A deadline of one month applies for the submission of the grounds for the appeal. The appeal has suspensive effect. This means that deportation is suspended until the court makes a decision. Asylum seekers retain their “Aufenthaltsgestattung” for the duration of the court proceedings. This is
As long as you have the “Aufenthaltsgestattung”, you can not receive the “Ausbildungsduldung” as you are not obliged to leave the country (your asylum case is officially still ongoing).

Just to refer to the 7 days Éanna was mentioning in his very informative answer above: If the application is rejected as "manifestly unfounded" or "inadmissible," the action must be filed with the court within one week of service of the decision. Nevertheless, the one-month deadline for providing reasons applies. The action has no suspensive effect. This means that the BAMF decision, including the deportation warning (or deportation order), remains valid. Therefore, it is necessary to file an urgent legal protection application with the court together with the action—also within one week—requesting a stay of action. Otherwise, the residence permit expires, and the person concerned can be deported despite the ongoing legal proceedings.

i just have one more question. My lawyer filed the Klage via beA and confirmed with me that court has received it at the last day.
I called Ausländerbehörde a day later and they told me they havent been notified of the Klage yet because first Bamf has to update them about it.
How long will this take? I dont want to be deported in meantime if it takes longer than 30 days
