What is the future of this Aufenthaltserlaubnis 19d after working two years in the profession.

Question

The law on  resident permit 19d states, that after 2 years in the trained profession, one can get a work freedom permit into any job in the labor market in Germany without restriction .

I applied for an extension and less restrictions, but I got this feedback.

Seit dem 20.03.2023 Sie sind im Besitz einer Aufenthaltserlaubnis nach § 19d Abs. 1 Nr. 1 a AufenthG (Aufenthaltserlaubnis für qualifizierte Geduldete mit Berufsausbildung oder inländischem Hochschulabschluss in Deutschland). Nach einer Dauer von zwei Jahren, kann geprüft werden, ob Sie für jede Beschäftigung zugelassen werden können. Die Prüfung nicht eher als 20.03.2025 stattfinden. Bis dahin bitte ich Sie Ihre Lohnabrechnungen unaufgefordert an mich zu übersenden.  

Please what are my chances of getting this application done to my favor?

I will be sending the payment slip of March 2025 in April as soon as I get it, they have every other payment slips from 2023 till date.

Dear MIKE 130, 

Welcome back at Wefugees and thank you for reaching out to us again. 

In paragraph 19d (2) German Residence Act it says: "After two years of employment corresponding to the professional qualification, the residence permit entitles the holder to any employment". 

As I understand it, the cancellation of the restriction to a specific job is therefore not optional, but the rule after 2 years - when the residence permit is extended. The residence permit will be extended if the requirements for its issue continue to be met. The residence permit includes a work permit for any type of employment if you have worked for two years in accordance with your training qualification. As I understand it, the immigration authority will now check after two years whether the conditions for issuing the permit are still met. If they then extend your permit, you no longer have to work in accordance with your qualification.

Thanks so much for the clarification. I have worked in the field of my qualification for 2 years now, and i applied for extension of my resident permit and the foreign office approved the application after the required documents from me. However on the day of my thumbprint, I reminded the lady in the office about this work restriction and she demanded to see all the payment slips from 2 years in my profession. Which I have summited to her and the lady requested for the payment slips of March 2025 too after which she will decide if there will be no restrictions on the renewed resident permit.
