I can only give you information here about the situation in Germany.
If your girlfriend comes to Germany, she will not be an asylum seeker. She will be a refugee according to the ‘temporary protection’ law brought in by the EU for Ukrainians. This status is also often referred to as ‘paragraph 24’ in Germany. She does not need to apply for asylum but must register with the immigration authorities.
You can only receive the residence status under paragraph 24 if you can prove that you as a couple are in a long-term lasting relationship. In general, the authorities require the relationship to have lasted at least two years. They are, however, required to take other factors into account and not just the length of the relationship.
Here are some examples of things they consider to indicate a serious relationship:
- Having a rental contract together and sharing rental costs
- Having children together
- Financial responsibility for one another, shared banks accounts etc.
They **** at the overall situation in order to assess whether they consider it to be a serious relationship. If you cannot provide such evidence, then you should **** at whether you may have a residency right in Germany independent of your girlfriend due to having to leave Ukraine. Here it depends on your residency status there and your nationality.
