Question

Good afternoon sir/ Ma, regarding the new law ( Chancenaufenthaltsrecht) there is something about this law which is not clear to me. 1. What does the cut off date ( 31 October 2017)  simply mean on this law. Do
2. Does it mean someone who enter Germany 31 December 2017. Can not obtain this residence permit. Because the law is a bit confused. We were told anyone who has live here in Germany for 5years can obtain this residence permit when is holding Duldung but the cut off date is what is confusing here.
3. Does the 5 years end with people who are here from 31 October 2017 to 31 October 2022? Please give me more details on my questions Thanks

Welcome back to the Wefugees Community and thank you for reaching out to us again.

I understand that the mentioned date in the "Chancen-Aufenthaltsrecht" can be a bit confusing.

It basically means that this law is a one time chance for people who stay in Germany since five years (or longer) by the end of October 2022. It also means that people can not "wait" in the future until they are in Germany for 5 years - anyone who arrived after October 2017 will, unfortunately, not be able to benefit from this law.

But the Law is valid untill 01 .01.2026,what does it mean?That means someone who reached 5 years in 2024 or 2025 will Not be eligible to apply?Its more confusing,kindly make it more clear..

Yes, that is correct. Unfortunately it is not possible to "wait" until someone reached the 5 years. People who arrived before November 2017 (and meet the other requirements) have time for 3 years now to apply for the residence permit. Is it more clear now?
