First of all, I am very sorry to hear about the negative court decision. From my perspective, you should discuss your chances for an appeal with your lawyer or a legal expert who knows your background well.
I am thinking about alternative options for you now. I don't know if you are holding a Duldung already, but I remember that we discussed in one of your previosly opened threads the "Beschäftigungsduldung" already, right? Did you ask your lawyer to check if you might meet the requirements? Regarding a work visa applying for at the German embassy in your country of origin: I am not too experienced regarding working visa procedures etc., but I read that without any formal qualification (like "Ausbildung" or higher education degree) it is very difficult to get a respective visa. You may also want to get some information at the "Make-it-in-Germany Website". Or did you actually complete a vocational training ("Ausbildung") in that mentioned restaurant? If not, is there an option to get enrolled in official vocational training? If you are holding the "normal" Duldung for at least 3 months and you start a qualified Ausbildung, the so-called "Ausbildungsduldung" might be another perspective?
