Hello please my son’s father doesn’t want to do the Vaterschaft,I have no contact with him anymore.Last week I went to the Standesamt to check if my child’s birth certificate is finish,But the Standesamt said they wrote him a letter for almost 3 months now but he hasn’t reply and they said ,they will try again also I’m a Duldung holder but my child’s father have a residence permit here.I want the birth certificate and the Vaterschaft because the auslanderbehorde said they need it to give me a residence permit in Germany.My child is 2 years old.Can the auslanderbehorde deport me ?Please what should I do?

I have already done DNA test at the court with my lawyer and he’s the father.The Standesamt has all the documents from the court that proves that he’s the father.But he doesn’t want to do the Vaterschaft

Welcome to the Wefugees Community and thank you for reaching out to us. 

First of all, I am unfortunately not an expert on family law. But I made some research and read, that applying for the "determination of the paternity" at your local family court/district court (Familiengericht/Amtsgericht) might be a possibility. You could also ask for a "Beratungshilfeschein" at the district court, if you can prove, that you can not afford to hire a lawyer. Holding that paper, you can consult a on family law specialized lawyer for a small fee (currently around 15 euros). Nevertheless, the lawyer can not support/defend you in the actual legal proceedings in court.
