Hello everyone, I’m currently still in the asylum process in Germany. I recently submitted an Umverteilungsantrag because I received and signed an Ausbildungsvertrag as an Anlagenmechaniker in RLP. The company also provided me with a strong supporting letter, confirming they want to train me and help me get settled.

However, the receiving Ausländerbehörde informed me in a letter that they plan to reject the application, saying that starting an Ausbildung is not a valid reason for approving a transfer. But they gave me the opportunity to respond and explain my situation once again before making a final decision.

This Ausbildung is a serious opportunity for me to integrate, learn a profession, and build a future in Germany. In my current location, I’ve searched for months and haven’t been able to find any suitable Ausbildung positions. The company  urgently needs trainees, and they’re ready to support me throughout the process.

I also want to add that I have an uncle living near Pottum, and he has offered me free accommodation if I move. This would make it easier for me to settle, reduce my financial burden, and allow me to focus fully on my Ausbildung.

Also, I saw on the official website of the Bezirksregierung Arnsberg (NRW) that an Ausbildung is considered a valid reason for approving an Umverteilung – especially when there is already a signed contract. That makes me confused about why it’s being rejected in my case.

I have two main questions: 1.    What should I write in my response to the Ausländerbehörde to improve my chances of approval? 2.    If the application is finally rejected, is there any other type of application or legal way to still be allowed to move and start the Ausbildung?

I’d be really grateful for any advice or if anyone has been through a similar situation. Thanks a lot in advance!

Hi Friend, that’s a tough situation to be in. Trust me I was in the same situation last year but the other way round. The ausbildung authorities in my city was refusing to approve my ausbildung  stating it was too far etc. I fought them for 2 months alongside my advisor. They told me to apply for Umverteilung and if the ausländerbehörde in the new city approves, then they will approve my Ausbildung. The receiving authorities said I should provide them with a rental agreement and 3 months salary for my Ausbildung salary. And then they will consider my application again, they didn’t reject it, they just said it was incomplete. I had to go to my Ausländerbehörder every week to fight this because I told them how am I suppose to give them 3 months statement if I’m unable to move etc, it was just a constant back and forth. But my company ended up calling the receiving ausländerbehörde and they actually approved my move the same day.

So maybe ask your company to do the same thing, tell them to reach out to the recieving authorities and explain to them that they need you etc and if your uncle can write a letter that you will be staying in his place for free, I think it will also help. But if you have to contact them yourself. Just tell them that you have applied everywhere in your surrounding area and have gotten only rejections and even cities around your city. All you keep getting is rejections. And that this is the only company that accepted you.

If you will be able to take care of yourself, like secure your livelihood, reach out to them and tell them that aswell but they need proof. Probably **** for a minijob in the other city to increase your monthly income. So then you will have higher chances which is either Umverteilungsantrag Oder Antrag aufhebung der Wohnsitzauflage which means you are applying for the authorities to Remove the residence restrictions since you are Securing your own livelyhood and it will allow you to live in any City within your State.

For Exemple my sister applied for Umverteilung and was Denied, but when she applied for the second one she got approved. Because she was in her own place, securing her own bills and literally not having any help from the government. But it’s different for her because she is doing ausbildumg in nursing and they receive a very high allowance. I don’t know how yours work but reach out to an advisor, they will tell you what to do. Everything I told you I did or the steps I told you to take were all the steps I was told to take by my advisor.
