Hello, i got a letter of asylum refusal today and i was asked to leave Germany within 30 days or apply for an appeal within 2 weeks while im enrolled in a bachelor program. Can i apply for a duldong to be able to stay and finish my studies? How can i apply? And what are the documents needed?  (I still have a valid student greek resident permit can i do anything with it in the meanwhile while it's still valid)? Thank you

Dear @Adeeeioua,

Welcome back to the Wefugees Community and thank you for reaching out to us again.

First of all, I am sorry to hear about your rejection. I am not a lawyer, but I am afraid that it will be difficult to get issued a Duldung based on/because of your studies (whether you might have another reason to get issued a Duldung will be checked and depends on your individual situation). At the end it is at the discretion of the immigraiton office. We discussed a very similar question here.

The fact that you are holding a Greek residence permit probably doesn't help here. Exept that you might be able to apply (if meeting the respective requirements) for a corresponding visa for Germany for study purposes in Greece (apart from your country of origin). My colleague explained this here in one of your earlier opened threads as well.

Or do you assess the situation differently dear @mbeon-fardeen or @mbeon-Éanna?

In any case, I highly recommend you to get support in a counselling office - let us know if you need help with finding one in your area.

All the best,

Meike

Where can i find a counselling office in kleve please?

I see the situation as my colleague @Meike

A standard Duldung is issued for reasons such as not having a passport or being medically unable to travel. A Duldung is not issued for a person to do university studies, unlike for example if a person is doing an Ausbildung, when they then get the special ‘Ausbildungsduldung’.

The only possibility I see is if you are close to finishing your studies. As I explained in the answer my colleague made reference to, the immigration office has discretion to issue a Duldung in other situations and generally would do so if a person is coming to the end of their schooling in Germany and has the opportunity to get a school certificate (Abschluss). If you are in a similar situation with regard to your studies, then make an application in writing for this discretionary Duldung. Include information about the course you are doing, how long it will last and what your results have been on the course so far.

I looked for counselling offices in Kleve in NRW. If you are under 27 years of age, you should go to the youth migration office JMD:

https://***-jugendmigrationsdienste-de.translate.goog/jmd/kreiskleve?_x_tr_sl=de&_x_tr_tl=en&_x_tr_hl=en&_x_tr_pto=wapp

If you are over 27, then these organisations can help you:

There are other places called Kleve in Germany. If you are in one of them, you can search yourself here:
