Good day,
I have been in Germany since March 7th, 2019. We are family of six and we have Duldung on our Ausweis since a year now. Are we qualified to apply for paragraph 104c by March this year?

Dear @paulo1976,

Welcome back to the Wefugees Community and thank your for reaching out to us again.

Unfortunately, the residence permit according to section 104c of the German Residence Act (the so-called Chancen-Aufenthaltsrecht) is a one-time key date regulation. It says that people may be eligible who stayed in Germany for minimum five years by the end of October 2022. So everyone who came to Germany later than October 2017 can not apply.

The residence permit according to section 25b (which we discussed in one of your earlier opened threads) is not a key date regulation though. We tried to give an overview of the respective requirements here.

I hope this helps and please don't hesitate to get back to us with any further questions.

All the best,

Meike

Thank you for your immediate response to my message.  We actually applied for the paragraph 25b. We are awaiting their verdict regarding the application. We could not provide two requirements out of eight requirements they asked for.
