Dear @Hakeem,

Welcome back to the Wefugees Community and sorry for the rather late reply.

I assume you haven't received an answer yet because it is quite impossible to give reliable information on how long procedures take. Is there any update you can share with us?

I really hope that you discussed your decision carefully with a lawyer or an experienced counsellor though, as my colleague Éanna recommended in one of your earlier opened threads here. In respect to a "Duldung" (temporary suspension of the deportation), you have to apply for it at the immigration office. As my colleague mentioned in his answer I linked above, the Duldung will not be issued automatically - instead there need to be a reason why you can not be deported for the time being.

I hope this helps and please don't hesitate to keep us updated and to get back to us with any further questions.

All the best,

Meike

It was my lawyer who proposed the idea of withdrawing my asylum to apply for a residence permit. I myself even went to the Auslanderbehörde and asked the woman about my case and what she told was I need to be in duldung inorder to apply for a residence permit 104c or 25b and I asked her if I happen to withdrawa my asylum do I need to be scared about deportation and her respon was no I should not be scared I need the duldung first inorde to make any application. Until now I have no response from bamf otherwise my lawyer would have told me and she's the one who wrote bamf about the withdrawal..
Can you please enlighten me of what you mean by I have to apply it at the immigration office (duldung) and can I do that prior for waiting BAMF to approve the request of withdrawing my case??
Thanks in advance

Dear @Hakeem, Thank you for your explanations and your update. I think you did right and I am relieved to hear that everything was planned well together with a lawyer. I am sure he or she will also inform you about the next steps. I just wanted to mention that a person needs to apply for the Duldung formally - it is not issued automatically. I recommend you to contact your lawyer with these detailed questions as he or she is the one familiar with your individual case. As long as you are officially in the asylum procedure, the immigration office will not issue a Duldung. I hope this helps and all the best, Meike
Dear @Mike yes everything was planned with my lawyer and I infact went a step more to involve some social workers one of them called on my behalf to asked the Auslanderbehörde about withdrawing my asylum inorder to apply for a residence permit and what she got from the Auslanderbehorde was it make sense if I take my asylum back when I have the duldung then I can apply for the residence permit because I have a good chance according to the Auslanderbehörde but the problem is that I'm not in duldung status. And what my lawyer told me I should not worry about deportation (they ate mostly deporting peoples with criminal records) and I can attest to that..
