Hi all,

I am a failed asylum seeker from Ghana in germany with duldung.

My question is: If I manage to get my passport and visa to reunify with my wife that lives abroad, can i just get a plane ticket and leave Germany  or must I inform Auslanderbehorde first?

i am scared they will take my passport and retain it for long.

Thank you

Hi @Moro11,

I do not see any reason why the Ausländerbehörde would retain your passport if you are planning on leaving the country anyway. In my view, it is best to inform them that you have received a passport and can now leave Germany, as you are currently obliged to do.

The Ausländerbehörde can issue you with a paper called a Grenzübertrittsbescheinigung which you give to the border control upon leaving Germany. This confirms you have left the country and means you will not have any issues if you wish to enter Germany in the future. If you have not clarified the situation with the Ausländerbehörde before travelling, I do not know to what extent you will be questioned by border control when leaving the country, even if you have a valid visa and passport for the country you are travelling to.

You also need to inform the Sozialamt you are leaving Germany if you are receiving benefits (Leistungen) from them.

Best,

Éanna

Hi! Thank you for your question, we are happy to help you. Do I understand correctly that your asylum procedure in Germany is still ongoing and you want to continue trying? Or are you trying it in the country where your wife lives right now?

Kind regards Saskia

Hi Saskia.
My asylum case is closed. I have been rejected and they are trying to basically deport me but they need to clear my identity I have a duldung.

Now, i am married and my wife lives abroad and I want to move there with a normal visa. Not for asylum.

If i get it, can I just go or do i have to inform Auslanderbehorde?
I don't want problems at the airport with border police.
Thank you
