Good day,

I would like to ask  a question.As a refugee,i have appeal my asylum case in court Germany,if i loss the case in court.Did i have another option to re appeal.Also,as a refugee that my case is still in court.I am working,i was giving approval to live in my rented apartment,i am going to German class,is it possible for me to apply for Residence permit from Foreign office apart from my asylum case.

My children are also living in Germany but they have not gotten document.One of them has American citizeship.Kindly advise me.

Welcome back to the Wefugees Community and thank you for reaching out to us again.

First of all, you are doing really well that you are already working and participating in a German course! Learning the language, getting independent and integrated into the German society/labour market could definitely help you in the long run. I am also glad to hear that you got the permission to rent an appartment. 

For the time being, you may wait for the outcome of your appeal. I hope you have a lawyer supporting you here? In case you receive a negative answer from the court, re-appealing might be possible. However, latest at this stage it is highly recommendable to hire a lawyer. I found some court rulings published online on similar cases (I remember some of your personal circumstances from your last thread). Some administration courts ruled that single mothers from Nigeria should not be sent back, due to the potential difficulties to secure the family's livelihood without any reliable support of family members. However, I am not a lawyer and don't have the whole overview in this regard. Unfortunately, court rulings may also vary significantly and I am afraid that there are many factors to be considered. Therefore, please discuss your thoughts and doubts with your lawyer. If you haven't hired one yet, you may share your approximate location and I will make some research on counselling offices you can contact in the first place. I am sure in these migration specialised centres they can also recommend you experienced lawyers. 

In case you are not able to receive a "deportation ban" (see Handbook Germany's explanation on "national ban on deportation"), for instance, the so-called "Ausbildungsduldung" might be an option for you in the future. Please follow the link for more information on this topic.
