Resident permit permanently

Dear wefugees team ,

On the behalf of my friend .

He is living in Germany since September 2015 as a refugee. In 2020 he got Besichtigung Duldung for 30 months. He is working full time since November 2016 till now .

Few questions to be asked .

If he get a resident permit  for two years after 30 months. When he can apply for Niederlassung resident permit ? Will the time he spend in asylum process as Aufenthaltgestatung and Beschäftigung Duldung will be count or not as he fulfilled all the criteria like 5 years full time work and B1 and Leben in Deutschland certificate

Welcome back to the Wefugees Community and thank you for being such an active member.

As far as I know, the period of the pending asylum procedure (with a negative outcome) and the time of holding a Duldung can unfortunately not be “counted” for the Niederlassungserlaubnis (permanent settlement). Instead, an applicant needs to hold a residence permit for at least 5 years in order to qualify.

I did not get it what you mean by holding residence permit for 5 months .
Is it not holding a residence permit for 5 years ? Please advise

Can the time be shorten if a person worked for 5 years in Duldung and having B2 level German language certificate and Leben in Deutschland certificate.
