Hi! I've been persecuted for being gay in Honduras. I bought a ticket to Munich with a layover in Madrid. Will the German authorities send me back to Spain to have my procedure completed there or I can still do it at the Munich Airport?

Dear @seezins_carrera,

Welcome to the Wefugees community and thank you for sharing your situation with us!

It might help to outline when Dublin III applies in general:

  • if you have applied for asylum in another country that is part of the Dublin regulation and your asylum claim is still ongoing
  • if you have applied in another Dublin country but have withdrawn your application
  • if you have applied in another Dublin country but your claim has been rejected
  • if you have a visa or residence permit from another Dublin country (because of a national ban on deportation for example)
  • or if your fingerprints have been filed in another Dublin country before you entered Germany (using the shared central fingerprint database EURODAC)

I've had another **** and in your case, entering the Schengen area as a Hondurian citizen, you do not need a visa - if you are planning on staying less than 90 days (they might ask you at immigration). Here's a website stating travel requirements.

A Schengen visa is mandatory for all nationals of Honduras who stay in the country for a period greater than 90 days.
For short stay visits (less than 90 days within a period of 180 days), the visitors are exempted from obtaining a valid Schengen visa.

I'm unsure how strict the immigration processes are at the airports in Spain and whether or not they take your fingerprints, or if Germany would see your layover as a reason to send you back there.

That is why I will link our asylum law expert @Nilab here, to check if there is anything I overlooked and what legal steps apply to you.

In the meantime, feel free to reach out to us again if you have any more questions.

All the best,

Isa
