DEAR community.I am doing an Ausbildung in Germany (not related to any assylum procedure) and I fortunately found a better one and have already signed my contract. Since, until August I don't want to continue my current Ausbildung I'm going back home so I sent my Kundigung to my firma. Would I be in trouble if I leave earlier than the date I signed for? Whats the worst case scenario? And you think it's a problem not to finish my first year of ausbildung and just go back home for 1 month?

It's possible to resign an Ausbildung. Usually, you have to give a 4-week notice in order to do that. After handing in the Kündigung you should stay with the company that you are currently doing your Ausbildung with, until the four weeks have passed. After that it shouldn't be a problem to start your new Ausbildung.

Quick question: Are you a refugee with a residence permit, or what exactly is your background?

In general, it's totally fine to decide to change the subject of your Ausbildung and/or the company you are doing it with. And of course you are free to do whatever you want in the meantime. If you are a refugee, however, returning to your home country is not a good idea because you will lose your refugee status in Germany.

First of all thank you very much for your answer.
1. Actually my boss decided when he wanted to give me the possibility to resign, only when it was profitable for him, even though I needed to be home earlier. I really need to leave 1 week before the deadline he made for me. Do you think he will cause me trouble?
2. I am not a refugee, I just came here for the ausbildung, and I have a 3.5 year residence permit, associated with a letter that "conects" it to my current firma. I shouldn't loose status if I leave for 1 month right?

1) I can't tell you how he will react, but if there is a deadline until which you have to work there (e.g. 4 weeks after quitting), I'd recommend to do that. Does your company have a "Betriebsrat" or an "Auszubildendenvertretung" that you can contact? They might be able to help you, especially since your boss seems to treat you in an unfair way.

2) If your residence permit is directly connected to your Ausbildung, the situation might be different compared to what I wrote in my initial answer. Did you get in contact with Ausländerbehörde to ask them about the possibility of traveling home for a month? And did you ask them about the options of switching Ausbildung? (If there is someone that can give you valid advice in this regard, then it's the authority that issued your residence/work permit)
