Hello, I am having a problem with getting reiseausweis. I have been accepted for fluchlingseigenschaft since January and have permit to stay for 3 years. I also have registered in JobCenter and is now allowed to find work. I also have received the Aufenthaltstittel. But I still have not received my reiseausweis. The sozial gave several dates for meeting regarding reiseausweis but only to inform that I should wait. They have even taking photo for it but today they said I will not receive the reiseausweis. When I asked for the reason, they refused to explain and refused to give date for another meeting. After this, I asked in JobCenter for what the reason might be but they also said the same.

In such situation, what can I do in order to receive the reiseausweis? I have no ausweis from the sozial for 2 months now and I would like to know what might be the reason for this situation.

If you formally asked for a Reiseausweis they should give you the reason why they refuse to give it to you (in writing). You have a right to a written explanation.

The only thing I could think of is that they are not sure about your identity, because they may not have enough proof for your identity yet.

May I ask which cíty refused it?

Thank you for the reply. I have finally received my Reiseausweis. It was refused in Berlin but as you mentioned, they did not receive all the correct papers in the time estimated.
In Berlin this is a wellknown bad practize of Ausländerbehörde, but anyhow against the law. Only if a lawyer applies for Aufenthaltstitel and Passport you will get it soon! So you should get a "Beratungshilfeschein" and go to a lawyer.

Die Praxis der Berliner Ausländerbehörde, nach einer Flüchtlingsanerkennung des BAMF zunächst nur auf Kopfbogen der Ausländerbehörde eine Bescheinigung über den er-laubten Aufenthalt auszustellen, um im Anschluss an das Asylverfahren zunächst eine Monate andauernde, erneute Prüfung von Identitätsdokumenten abzuwarten, ist rechtswidrig.  Zum einen ist nach der AufenthV für die Fiktionsbescheinigung der amtliche, fälschungssichere mit Hologramm versehene grüne Vordruck der Bundesdruckerei zu verwenden.

Vor allem aber ist der Anerkennungsbescheid des BAMF für die Ausländerbehörde bindend. Zu den Aufgaben des BAMF gehört es, im Rahmen des Asylverfahrens die Angaben der Gefüchte zur Identität auf Plausibilität zu prüfen und ggf. vorgelegte Dokumente auf Echt-heit zu prüfen. Liegt der Asylbescheid vor, sind die Aufenthaltserlaubnis und der Flüchtlings-pass gemäß § 25 Abs. 1 und 2 AufenthG zwingend auszustellen, es besteht kein Ermessen. Eine zusätzliche Identitätsprüfung durch die Ausländerbehörde ist unzulässig, § 5 Abs. 3 Auf-enthG. Ggf. kann das Ausweisdokument mit einem Hinweis versehen werden, das die Anga-ben zur Identität  auf eigenen Angaben beruhen. Das der Aufenthaltstitel und der Flüchtlings-pass bzw. Reiseausweis ungehend auszustellen sind, ergibt sich auch aus Art. 24 und 25 der EU-Qualifikationsrichtlinie und aus Art. 27 und 28 GFK.

Wir empfehlen daher, sich mit einem Beratungshilfeschein (mehr dazu imKapitel „Einen Antrag stellen“ in diesem Ratgeber) an eine AnwältIn zu wenden. In der Praxis wird die Auf-enthaltserlaubnis umgehend umgehend erteilt, sobald eine AnwältIn dies bei der Ausländer-behörde einfordert!
