are you allowed to lenghten your ausbildung?

im currently not on ausbildungsduldung, im on aufenthaltsgestattung but im doing my ausbildung. i just finished my ausbildungs first year and my teachers want me to repeat the semester because zwischenprüfung partner was incompetent in the exams and wouldnt let me practice with her and in studies and i couldnt learn well (im doing physiotherapy and she was actually kicked out of the school for being unreliable)
now on my aufenthaltsg. it says "ausbildung längstens bis 30.09.28" erlaubt. i started in 10.2025. can i tell ausländerbehörde that it will be lenghtened a bit? im not thrown out of the school or anything but is it banned to fail?

Hi,

As long as you are still doing the Ausbildung in the Autumn of 2028, then the remark on your Aufenthaltsgestattung should be extended. If you do not complete it by 30.09.28, then they will need to see proof that you are still enrolled on the course.

What I don’t fully understand is why you have a remark on your Aufenthaltsgestattung about the Ausbildung. Are you doing a ‘duale Ausbildung’, i.e. working at a company part of the time and in school the rest of the time? In Germany, physiotherapy is usually offered solely as a school-based ‘schulische Ausbildung’. For a schulische Ausbildung there is no permission needed from the Ausländerbehörde.

its schulische yes, i dont know why as well. we have praktikum in the school but its not working (duale ausbildung).
i failed 3 of my zwischenprüfung and my teachers suggested me to repeat the semester so my graduation date will be in 2029. can ausländerbehörde try kicking me out because of that? i will still be officially enrolled in school

As it is a schulische Ausbildung, the permission of the Ausländerbehörde for the Ausbildung itself is not required. You only need permission from them to do the Praktikum and so it should state something on your Aufenthaltsgestattung like ‘Das Pflichtpraktikum bei [Firma/Einrichtung X] im Zeitraum vom [Datum] bis [Datum] wird erlaubt‘. You cannot be prevented from continuing the Ausbildung on immigration grounds when the Ausbildung does not require their permission.

thank you. i was thinking about changing to a berufliche duales studium in the pflege sector instead but is my schulische ausbildung better for me in this situation?

A duales Studium will mean that in part you are doing a betriebliche Ausbildung. To do this, you will require work permission as long as you are in the asylum process or if you receive a final negative decision in your case and then have a Duldung. Permission to work when on a Duldung generally requires that a person’s identity has been clarified (Identitätsklärung) but that it a complex matter.

As regards the offer from your school, I do not see any issue as you do not require work permission for a schulische Ausbildung in the first place. Therefore, whether you re-start the Ausbildung is not relevant to the Ausländerbehörde. The only aspect of the Ausbildung you need permission for is if you do a Pflichtpraktikum.
