Hi everyone. So my question is, I have been going through a lot in my marriage here in Germany and I will like to separate with my husband we are having 2 kids. I went to Caritas ,red cross familia pro but not getting any answer. Can someone please help me with some advice?. I am not working but doing a Fortbildung and my husband is working. But I will like to leave without him knowing.

I’m sorry to read that you were unable to get advice up to now. Do you mean you were unable to speak to someone at those organisations or that they were unable to answer your questions? If you detail what questions you have here, we will do our best to answer them.

If you would like to leave your husband and have nowhere else to stay, you can stay at a women’s shelter. This is called a ‘Frauenhaus’. Your children can also stay with you there and your husband will not know where you are. You do not need to speak German in order to get help there. The Frauenhaus has staff there who can assist you with things like your immigration status and getting financial assistance.

If you have a resident permit in Germany based on your marriage, then it will be according to paragraph 28 (if married to a German) or 29 (if married to a non-German). This will be written on the front of your residence permit (Ausweis – Aufenthaltstitel).

If your children are German citizens, then you can change your permit to one for the parent of a German child without any issue. Otherwise, it depends how long you were married in Germany. If has been more than three years, then you are entitled to a residence permit independent of your husband.

If it has been less than three years, then it is only possible in certain cases such as domestic violence. This article (in English via online translation) gives some more information on this possibility:

If you do not wish to go to a Frauenhaus and have somewhere else to stay, then you can block your husband accessing your new address. People can generally access information on other people based on what’s recorded when they registered their address (Anmeldung). This information is called ‘Melderegisterauskunft’. If you have a reason not to want other people accessing this information about you, then you can block access to it in a procedure called ‘Melderegisterauskunft sperren’.
