Hie my name is Joyce l am an asylum seeker in Germany and I have a boyfriend who is Belgian.l have been in the asylum process for one year l haven’t received a rejection or an answer or a Dublin letter. I was wondering if it is possible for me and my boyfriend to get married in Germany since l am an asylum seeker and l am not allowed to leave the country at the moment ? Me and my boyfriend we both have never been married before

Hi

Ich habe die gleiche Erfahrung gemacht wie Sie. Es kommt darauf an, aus welchem Land Sie kommen, denn Deutschland verlangt für jedes Land andere Heiratsdokumente.
 Ich bin gescheitert.
 Denn das Register muss mich zwingen, in mein Herkunftsland zu gehen, um eine Ledigkeitsbescheinigung zu erhalten.
 Aber ich bin ein Asylbewerber, das geht einfach nicht.
 Es ist schwer, in Deutschland zu heiraten, besonders für Flüchtlinge.
 Ich wünsche Ihnen viel Glück.

In my country a family member can get it for you so if l obtain it is it doabl?
Aber für mein Land mussten sie mich zwingen, zur Botschaft meines Herkunftslandes zu gehen, um die Dokumente zu holen, ich hatte auch mit der Standesamt gesagt,ich lasse  meiner Familie anvertrauen, ich habe die Dokumente aus meinem eigenen Land geholt, und das Standesamt hat gesagt, nein, sie müssen sich, zur Botschaft zu gehen, um ich dafür zu holen, sonst müssen Sie warten, bis Sie das Asylverfahren gewonnen haben, bevor Sie meine Freundin heiraten können, und sie sind absolut rassistisch.

If you wish to get married, you have to first contact your local marriage registry office called the ‘Standesamt’. You and your boyfriend have to submit certain documents to them. Once they have checked the documents are in order, you can set a date to be married.

The standard documents required are a passport, birth certificate and a certificate of eligibility to marry (Ehefähigkeitszeugnis). They may require additional documentation depending on your nationality and situation.

The certificate of eligibility to marry in Belgian is called Certificat de Non-Empêchement au Mariage in French. Your boyfriend has to apply for this from the Belgian embassy in Berlin as he intends to get married in Germany. Not all countries issue this type of document. In such cases, and for other people who are unable to obtain this certificate, they can be allowed to marry without it. For this the person must make an application called ‘Antrag auf Befreiung von der Beibringung des Ehefähigkeitszegunisses’ at the court called Oberlandesgericht in the German state where you live.

As noted already, it is often difficult to marry while in the asylum process. But this depends on your individual situation and what documents about your identity and marital status that you have. As long as you are in the asylum process, you cannot be expected to make contact with the embassy of your home country. However, it may be possible to obtain documents from your home country by authorising family members or a lawyer to do so on your behalf.

As an exception, the officials at the Standesamt can accept a person’s sworn statement (affidavit) about their identity, marital status etc., if it is otherwise extremely difficult and/or expensive to get these documents. This is only accepted in cases where the person has clearly demonstrated the costs/difficulties associated with getting documents.
