Hello everyone i really need help . I have a son in germany has is 6 year old . The mother doesn't want .me to have access to him like call and gift to him she block me on whatsapp . Im currently in germany im unable to send money to him due to i get 600 euro in month . I sometime send 50 euro.  The mother complained is too small . She said she cancel the 50/50 right that i have to the baby . Is that even possible.  The baby has her name only . But the birth certificate shows I'm the father . Please i need help . Do i need a lawyer for this . I will be coming back to germany for work as soon as i receive my 10 year resident permit in italy i made finger print already.  Note . I was in germany but i was reject. Before the birth certificate was available.  And i was ask to leave the country.  But i work and pay child support when i was in germany . I really need help . Hi. l am not sure if its possible to cancel 50/50 which was made already. She also can't deny you access to your child. You can contact a lawyer or Jugendamt for assistance. Another thing maybe she applied for maintenance advance from Jugendamt and she is getting more money and hence she blocked you. All the best my brother

I’m neither a lawyer not an expert in family matters but wish to give you my assessment of the situation. It is not possible to simply ‘cancel‘ the shared custody rights of another parent. If one parent wishes to have sole custody, then they have to file an application to do so with their local family court. The court will **** in great detail at the situation and decide based on the best interest of the child. Both parents are involved in this process. The fact that you currently are not able to provide enough financial support is not enough by itself to remove your custody rights.

If it was the case that you had not been in contact with your child for a long period of time, had made no attempts to contact them and had made no efforts to financially contribute anything, then possibly at that point a court would assign the mother sole custody.

Once you are back in Germany and if you have any difficulty in asserting your custody or visitation rights, you can get help from the Jugendamt or an independent family advisory service (Familienberatungsstelle).

I do not understand why you had to leave Germany. You say the birth certificate was not available. But if there was at least a recognition of paternity (Vaterschaftsanerkennung) and declaration of shared custody, then this is generally enough to be issued a permit. Here, however, the nationality and residence status of the child plays a role.
