I'll be very glad if I happen to get an answer and clarification on our situation which follows as:

I met my wife in Ukraine, in November of 2021 and we've proceeded our relation since then. However, I had to back to my country, Turkey end of that month, November of 2021 and started living here. We planned for me to move back to Ukraine and live there, however, due to war, we could not manage that. My wife lived in Kharkiv, where her apartment is, till June 2022, which means she was in Ukraine before the beginning of war, and then she moved into Turkey where I live, and we've lived together since then. Furthermore, I and my brother launched a company in Ukraine in May 2023, and we've started doing business which I still hold the residence permit in Ukraine since June 2023. However, some incident occurred and led us to think of moving in Germany where we found work agreement for both of us, for me and for my wife. We happened to think about living in Kharkiv, where we have an apartment, however, the city is heavily under attack from time to time. Therefore, living in Eu, especially Germany, is the only option for us.
That's why I'd like to ask and get an opinion for our situation. Since we are married, after 24th February 2022 to be clear, and since I have residence permit in Ukraine, are we able to move into Germany by benefiting of paragraph 24. We are not willing to take any humanitarian protection and so on. We are just willing to obtain a residence permit till the war ends. I am aware of the fact that Ukrainian citizens are in position to obtain it without problem, and they can work there. My question is if I can travel with her to Germany where I have also a work agreement with a company.

Hi @Berkerk

As your wife is a Ukrainian citizen and was resident in Ukraine when the war started, she can benefit from paragraph 24 (temporary protection) if she comes to Germany.

As you were not resident in the Ukraine, you will not be entitled to paragraph 24. You can also not come to Germany as her husband as family reunification to people with paragraph 24 is restricted to the cases where the family was broken up due to war in the home country.

If you have a job offer, then I recommend you apply for a visa as a qualified worker at a German embassy or consulate in Turkey.
