Please I need an urgent help and answer because my wife reported to the immigration office that she is no longer interested in the marriage,

We got married 2018 but started living together 2019 june,

And my first residence permit was issued 2020 November

Our living together after our marriage is 3 years and 8 months

Now she has inform the immigration office that she wants out

To be qualified for paragraph 31 Aufenthalts

Is only the duration of marriage being counted or the time which the first residence permit was issued??

Please I need an urgent answer

Hi @Nwa d

It is the duration of marriage while resident in Germany that is counted. If you were married and living together in Germany for at least three years, then you are entitled to a residence permit according to paragraph 31. I recommend you now apply for this as the Ausländerbehörde has been informed of your separation.

In case you’re not already aware, for paragraph 31 it is not necessary to be fully financially self-sufficient. If you are receiving support from Jobcenter or other benefits, you are still entitled to a residence permit.
