My husband (a German citizen) and I (a South African citizen) got married in South Africa, but I plan on reuniting with my husband in Germany. 

My husband currently resides in Germany, he is employed, and our marriage has been registered. 

In order to reunite with him, I need to apply for a family reunification visa, on the visa application they ask; “what are the means of supporting myself?” AND “has a Verpflichtungserklärung been completed?”

Out of all the research we have done on the Verpflichtungserklärung, we keep reading that it cannot be used for a Family Reunification Visa or a National D Visa and that we need to contact the Ausländerbehörde or the German Mission Abroad. 

My husband and I have spent months trying to contact the Ausländerbehörde for answers, only for us to be shown away OR they ask us to send an email (which never gets answered) OR they say they can’t assist us until I am in Germany. 

I then, reached out to the German Embassy in South Africa, and they informed me that my “fiancée” needs to complete a Verpflichtungserklärung, BUT he is my husband and we are married, we do not intend to get married in Germany. 

If anyone has any advice on this matter, it would so kindly be appreciated.

Hi @Ruka

You do not need a Verpflichtungserklärung. You also do not need to show means of supporting yourself, i.e. as the spouse of a German citizen you are entitled to social welfare in Germany.

A Verpflichtungserklärung is necessary, for example, when the visa is to get married in Germany.
