My resident permit application was rejected because I didn't meet the required years of staying. 8 years as an adult, why with Minor 6 years? I am just 5 years and 1 month in Germany I also didn't meet the new Chancen-Aufenthaltsrecht. Because I enter Germany on December 24, 2017. can my company help me to fight the case in court and get a stay in Germany? Ist possible to win in court, I am presently working. For close to 3years now

@Dickson can one apply for the paragraph 25 without A2 certificate? I have two kids and this year make it 7 years in germany for me , though i don't have no certificate, i am working for almost 3 years now, i have unbefristet contract .. so is it possible to get 25 without A2 certificate? For your chancen , u have to be living from 2016 or below 2016 ... for the paragraph 25 , u are just 5 years , its 6 years when u have minors ... .. but I don't know if A2 is required to get the paragraph 25.. I don't want to accept the chancen Aufenthalt, i don't want it...

Dear @Dickson,

Welcome back to the Wefugees Community and thank you for your question.

Some of the requirements for the residence permit according to section 25b of the German Residence Act were changed at the beginning of 2023 - i.e. the time the applicant has to have stayed legally in Germany (6 years or 4 years with minor children). Please see a list with the conditions here.

In case you live in a single-person household, you may be eligible for the 25b in less than a year!?

@meike hallo, if i am living with my child for 3 years does it mean i can't apply ? This year i will be 7 years in germany and my first child will be 3years by tomorrow. Also does one need A2 certificate to apply or not necessary ?
Dear @felise, No, I guess you slightly misunderstood. If an applicant lives together with his/her minor children, he/she must have stayed (legally) in Germany for at least 4 years. Is it more clear now? So if you you stay here already since 7 years, you may be eligible! And you need to prove your A2 oral German skills! Best, Meike
