Dulding light will disapear with the new law in 2023 ?

Have Duldung light and wanted to know if there are chances that it disapears once the new law to give chance to Duldung holders to get residency for one year. I hear it is possible and that we must sign an affidavit for our identity and then we have a chance

Anyone can confirm we duldung light holders have a chance ?

Dear @Momokad,

Welcome to the Wefugees Community and thank you for your question.

Regarding the so-called "Chancen-Aufenthaltsrecht" (the one year "trial period" for long term Duldung holders), it is still valid what I described in this thread - as is it unfortunately not totally clear yet how and when it will be implemented. The details are still negotiated on federal government (parliament) level.

The current draft says, however, that people with a so-called "Duldung light" are also able to receive this one year residence permit. Within this one year, applicants need to clarify their identity though - which usually implies to submit a passport. Otherwise they will be issued a Duldung again.

And you are right: the current government parties also initially agreed in their coalition contract on abandoning the "Duldung light" in general. However, this policy change is not yet part of any legislative package or draft, as far as I know. I really hope the governemt will still stick to their original plans and publishes a respective draft/suggestion for the implementation of such a law soon.

I lost my job because of this duldung light and am miserable, sitting at home. It will be difficult to get my passport, But will see what happens

Well, have been to different associations, last in Koln and they tell me to wait for the change of law. I have a lawyer who tells me that a duldung light cannot be changed.
So, hearing of a new law and your answer today that confirms and clears even more what I need to understand , is quite a gift.

I had Duldung before and had the same full time job for years but because I could not get a passport (went to my embassy and it did not work), apparently they do not believe , even if they send people with you. In any case, they gave me duldung light, which does not allow me to work anymore. And that is horrible to stay home and not knowing what will happen in the future. Have little money to live on also and everything more complicated (like access to dentists, etc). But very depressing to not work.

@Momokad that means Duldung light is different from normal Duldung... for chancen, if u don't have criminal record , and u are using Duldung for some years , i think u stand a chance to get the one year chancen Aufenthalt, if they give u, start working immediately and be independent from social money and don't commit crime in that one year, learn a bit Deutsch too ...

Thank you and that is what I hope for. No, I have no criminal records. But some regions I hear are more difficult than other like Bavaria and North Rhine, imposing all rules that exist.
Not sure, but i was picked. Had no problems, quiet life, working hard, paying taxes, my bills on time and that happened and messed uo my life. had Duldung before like you

Hello again
The law came in few days ago, and no mention of Duldung light. At least it seems that only I one can get a passport (which seems to have been impossible for me until now-went to the embassy few times), so, nothing new on that side. And I spent money on different lawyers in the past and people in the same situation who have all the same answer. So, we are stucked still in the same limbo, it seems. Do you know more on this please ?
