Good day,

Please is it possible as asylum seeker to go to the country embassy to seek for new passport ?

Due to my working place told me they can get me contract of working permit.

My asylum case still in the court
Have appeal in court and this is second appeal
First appeal court letter ✉ late before getting to my address and making new appeal.

But in my working place asked me to get my country passport for them to get me contract permit.

Please anyone with idea.
Is this possible?
As I'm asylum seeker which I'm in there system
Is it going to work out without having problems with immigration?

Hi Mugbe,

I strongly advise against attempting to obtain a new passport or making any contact with the embassy of your home country. Doing so weakens your case that you are need of protection in Germany and can lead to having your asylum claim rejected.

Furthermore, it is not necessary for you to have a current passport in order to work. Your ID (Ausweis) along with the written permission from the Ausländerbehörde is enough for them to employ you. Here is information from the Federal Ministry of Work about your access to the labour market (in German):

https://***.bmas.de/DE/Arbeit/Fachkraeftesicherung-und-Integration/Migration-und-Arbeit/Flucht-und-Aysl/arbeitsmarktzugang-fuer-fluechtlinge.html;jsessionid=479F35A73CBDF85DEC588C6578CC95F1.delivery1-master#doc09e515fd-079b-45a0-a7dd-cc385159965fbodyText3

The company that wishes to employ you should fill out a form call a ‘Stellenbeschreibung’. This is not a job contract. It provides the details of the job they would like to offer you. You submit that form along with your own application for work permission (Arbeitserlaubnis) to the Ausländerbehörde. They will process it and if they agree, will write the permission on your Ausweis. The permission will only be given for a specific job with a specific company. You can then sign a work contract and begin to work.

Hope that helps, let us know if you have any other questions.

Best,

Éanna

Thank you very much for your response
Please if I may understand you.
No need of processing new passport?

My asylum case was firstly rejected
I appeal in court
Letter ✉ of court late to get to me.

Now i make new appeal again to let them know.

But manager in my working place was asking me such which i never attempt i only need to seek for advice first.

While my case in the court
I just re-appeal yesterday for the second time in case.

Do i have to wait for the court decision?
I only have copy of my passport to seek for asylum while i show them in the work and with my asylum ID

But asking me to get passport do can get me a contract permit to it

Just confused
As long as you are still in the asylum process (including any ongoing appeals), you cannot renew your passport. You need the employer to fill out a job description, send it to the Ausländerbehörde and if they approve, you can show this to your employer so it is clear you are allowed to work.

If your asylum case is conclusively rejected, then the situation changes and different rules apply about having to renew your passport.
Thank you very much for your helpful advice, dear @mbeon-Éanna!
