Hello. My name is ari from Malaysia. I am here on the behalf of my fiance' who is with Yemen Nationality.
My fiance' was granted as a refugee in Malaysia and got the UNHCR card. However since Malaysia did not sign UN Conventions on refugee which has caused many limitations to those refugees, my fiance' included.   

The problem here is my fiance' has overstayed his visa for a few months on his visa prior his UN application and keep continue to live legally in Malaysia for the next three years using his UNHCR card.

But, since Malaysia need to use visa to register the marriage, that has caused a big issue for us to get married.

The Yemen ambassy in Malaysia has told him that he has no choice and has advised him to go out and get into Malaysia again. But due to his overstay..he is now is ban from entering into Malaysia for 5 years.

He went to Germany to seek for asylum since he is unable to go back to his country, Yemen due to the war is still happening there.

But there is another issue here, on his way to Germany, he has lost his passport and register for asylum in Berlin using only a copy of his original passport...the date of his passport is still valid until 2023.

May I know if he is allowed to get for asylum in Germany for his situation?

We are planning to get married there and start our life together as a family since he is unable to return to Malaysia for the next 5 years and Germany seems to be the best country for our future together.

Dear @Arie

Welcome back to the Wefugees Community and thank you for reaching out to us again. 

Unfortunately, it is hardly possible to predict the outcome of an asylum procedure or to make any serious assumption here - especially without knowing your fiance's background and story. Every asylum application is getting assessed individually by the Federal Office for Migration and Refugees (BAMF). 

Was your fiance interviewed already? In case he is still waiting for the interview ("Anhörung"), I can only recommend to prepare this appointment as most important part of the whole process very well. There are counselling offices which are specialised in supporting and preparing applicants for the interview - it is the so-called "Asylverfahrensberatung". 

Please let us know if you need help in finding such an office close to your fiance's location.

Dear Meiki, thank you so much for your very fast respond, i really appreciate it so much. He is now waiting for the interview which is scheduled on 2/11/2021. He is now stay at Bundesarbeitskreis Berufsförderungswerke
,Waldkraiburg.

May I know if he was granted for asylum in Malaysia but is unable to come back to Malaysia for the next 5 years due to his previous overstay and also unable to return to his hometown in Yemen due the war is still happening, would that can help him to get asylum in Germany? Thank you so much :)
