Hello! On 6 April 2021 I got my Aufenthaltsgestattung with an Ausbildung permission written on it, it says I can start the Ausbildung on 1 July 2021, but then on 4 Mai 2021 came my asylum rejection from Verwaltungsgericht (adminstrative court), so my question is, can I apply for a Ausbildungsduldung now? The law says that people who already started their ausbildung while holding an Aufenthaltsgestattung can apply for an ausbildungsduldung but in my case it's only printed on my Aufenthaltsgestattung and will only start on 1 July 2021, my ausbildung is approved but I haven't started it yet

Dear @Mp,

Welcome to the Wefugees Community and thank you for your question.

We discussed a similar topic before in this thread - you may want to follow the link for more details.

From my perspective, you haven’t started the “Ausbildung” before the rejection of your asylum application. This doesn’t mean that you are not able to receive the so-called “Ausbildungsduldung” anymore. However, you may need to hold the “normal” Duldung for at least 3 months before you can apply for the Ausbildungsduldung.

Dear @mbeon-Christine, do you agree with me and/or do you want to add any information?

@Mp: In any case, don’t hesitate to get back to us with any further questions.

All the best,

Thank you so much for answering! If I appeal the asylum decision at the Oberverwaltungsgericht, will that stop my deportation during that appeal?
Hi Mp, Good day.
Were you successful to get Ausbildungsduldung ?
