Dear @Ejirans,

Welcome back to the Wefugees Community and thank you for reaching out to us again.

First of all, I would like to recommend you our comment function to get back to us once you opened a thread on a topic. This will allow us to keep a better overview and information in one place and will make things a bit easier. Here the link to your originally opened thread: Dublin case was closed now - What are my chances to get accepted as refugee in Germany?

You also opened a third thread adding the question: "A decision is still pending in the main proceedings. What does this mean please I received from the court?"

I will get to that question here as well and close the other thread, I hope this is okay for you.

Now to your question, if "winning" the Dublin case is already indicating towards a certain outcome in the actual asylum procedure. I am afraid that these two processes are independent from each other and the Dublin procedure is "only" determining, which country is responsible for your asylum application in terms of EU law. Therefore, it is hardly possible to predict any result regarding your application. If you received a letter from the court (was it a court or the Bundesamt für Migration und Flüchtlinge/BAMF?) saying that a decision is still pending in the main proceedings, I assume that you only can wait for the time being. You had the main interview at the BAMF already or will this be the next step?

I will also link our dear @alla_fka here. Maybe she can correct me or add some more information.

In any case, please don't hesitate to get back to us with any further questions.

All the best,

Meike

Hallo,

Meike is right. "Winning" Dublin just means that you stay in Germany for your asylum procedure, that means: Germany is responsible to check if your problems in your country of origin are serious enough to give you a refugee status, a subsidiary protection or another humanitarian protection against deportation to this country (or another country outside of Europe, against which you seek protection). Your reasons in this "dangerous" country usually have nothing to do with your problems in Italy.

As far as I understand from your question, the BAMF hasn't decided yet, if you can be deported to your country or not.

If you are still waiting for the decision of BAMF, you must check your post daily and make an appeal quickly, if you get a rejection (the time for appeals can be 1 or 2 weeks, depending on the kind of the decision). Naturally it is better to make it with a lawyer if you can afford it. If not, **** for a councelling center in your area to help you.
