They were rejected due to Dublin regulations. Want to know whether legal will fight their case in order for d kid to have protection and start school. Also they never request asylum in Germany which is their point of entry.

Dear @Jayman

Thank you for reaching out to the Wefugees community!

For a Dublin case, applying for asylum in another country is not the only „condition“.

If Germany, for example, issued the initial visa or they got registered there, authorities in the country of the current asylum application most probably will refer back to Germany for the case. Where are your sister and her daughter actually applying for asylum now?

Our platform and our experts are based in Germany. Therefore, we mostly share experiences, rules and regulations etc. concerning and applied in Germany.

However, we will try to support as good as we can - no matter the actual location.

All the best,

Meike

Yes they got visa for Germany but never registered for asylum in Germany. They are currently in Holland were they seek for asylum. Currently seeking help from social workers. Please advise which legal means to take to avoid transfer to Germany

If you came to Europe from Schenagan visa which issued from Germany; you must apply asylum also only in Germany. Technically you have applied asylum in Holland. However, due to visa issuance from Germany you got Dublin decision. You can appeal for the decision.

Thank you
