Application for residence permit acc. to §25 (5) rejected - What are the next steps?

Please what step can I take
My application for paragraph 25.5 was rejected by the Regierung Präsidium
I have a child with Aufenthaltserlaubis paragraph 33 and my Duldung is above 18months

Welcome to the Wefugees Community and thank you for reaching out to us.

Without knowing your personal situation, we can of course only make general explanations here.

If it comes to the residence permit accoriding to Section 25 (5), the immigration office (Ausländerbehörde) indeed has a scope for decision-making, which often makes the procedure intransparent and difficult to understand. As @Obumkelly79 mentioned already, understanding the rejection letter (or asking for it, in case you haven't recieved one) will give first hints in terms of the immigration office's logic and reasoning. At the end, hiring a lawyer to support you against the immigraiton office will most probably be the most promising option now. Please keep in mind, that talking to an experienced counselor could be a lower cost alternative or you apply for a "Beratungshilfeschein", for instance. @meike.thanks for your response.this is what I got from them das Landratsamt hat die Absicht Ihren Antrag auf Erteilung einer Aufenthaltserlaubnis abzulehnen weil das Regierungspräsidium keine Zustimmung zur Erteilung einer Aufenthaitserlaubnis erteilt hat. Gemäß § 28 des Landesverwaltungsverfahrensgesetzes (LVWVFG) haben Sie das Recht zu dieser Maßnahme angehört zu werden. Deshalb wird Ihnen hiermit die Möglichkeit eingeräumt, sich bis spätestens 27.01.2021 zu der beabsichtigten ausländerrechtlichen Maßnahme zu äußern. Dies kann aufgrund der aktuellen Situation (Corona-Virus) nur schriftlich geschehen. Bitte senden Sie uns das beigefügte Blatt entsprechend ausgefüllt zurück. Sollte Jedoch bis zum Ablauf dieser Frist von Ihnen keine Stellungnahme beim Landratsamt vorliegen, gehen wir davon aus, dass Sie auf Ihr Recht zur Anhörung verzichten und wir über die Ablehnung der Erteilung der Aufenthaltserlaubnis auch ohne Ihre persõnliche Außerung nach Aktenlage entscheiden.

Dear @Alliswell, thank you for your response. The text you pasted here is actually only saying that the "Regierungspräsidium " did not give the consent to issue the Aufenthaltserlaubnis. That is why the Landratsamt is planning to reject the application. They don't give any information on the reasons here. However, they set you a deadline (27th January) to respond in written form to them. I would highly recommend you to quickly contact a migration counselling office to get support on this! This is what I got from Ausländerbehörde
Die Abschiebung des/der o. G. wird im Auftrag des Regierungspräsidium Karlsruhe, Abteilung 8 ausgesetzt vom bis: 11.02.2021 05.08.2021 und ist mit folgenden Nebenbestimmungen versehen: Der Aufenthalt wird beschränkt auf den Bereich der Bundesrepublik Deutschland: Arbeitserlaubnispflichtige Erworbstätigkeit nur gemäß gültiger Arbeitseriaubnis gestattet. Selbständige oder vergleichbare unselbständige Erwerbstätigkeit nicht gestattet Gebühr. € 33,00 Rechtsbehelfsbelehrung: Gegen diese Entscheidung kann innerhalb eines Monats nach Bekanntgabe beim Verwaltungsgericht Stuttgart, Augus- tenstraße 5, 70178 Stuttgart, Klage erhoben werden. Die Klage ist gegen das Land Baden-Württemberg - vertreten durch das Regierungspräsidium Karlsruhe - zu richten. Ich wurde darauf hingewiesen, dass die Bescheinigung über die Aussetzung der Abschiebung im Auftrag des Regie- rungspråsidiums Karlsruhe, Abteilung 8, ausgestellt wurde. I.
