I came to holland in july and went back to Ghana in August and got france visa in December but i went to Germany straight will i be in the Dublin process. Im very ill as well if it can help me plus im gay. Im just scared of safe country of origin and Dublin. Any advice? Thanks

I went back to Ghana in one week from Holland i didn't seek asylum there and also after getting the france visa i traveled to Germany straight without landing at France. Also my fingerprint was taken in Germany. Even in Holland my fingerprint wasn't taken

Welcome to the Wefugees Community and thank you for your question. 

Your situation sounds indeed quite complicated. As far as I know, in the name of the Dublin regulation France would be responsible for your asylum case because they issued the visa. And as you mentioned, Ghana is one of the so-called "safe countries of origin" in Germany, which makes things more difficult. What happend back in Holland? The government acknowledged you as refugee or you held any other type of residence permit?

However, I assume it will be the best option to consult a lawyer or a migration counselling office. You might need support in collecting and presenting good reasons why your asylum application should be assessed/accepted in Germany. 

Please also keep in mind that you most probably will have only one week to appeal against a potential negative decision by the BAMF.

Dear @Shaften123,

Thanks again for reaching out to the wefugees-community. Unfortunately I have to agree with what @Meike has already said. In some cases it is possible though to stop the deportation to another EU-Country if you are severely ill and dependent on the care of family members or you can prove to the Bamf (through doctor's Reports or other documents) that a deportation would mean severe health risks for you. I do not know your personal situation quite well so I only want to add this as a general piece of information that might or might not apply to your particular case.
