Hello I would like to ask about changing the Ausbildung.

So, I’m non-eu and just started my ausbildung in Hotelfachfrau this February, and the probezeit is 4 months, so that mean now I’m still in trial period until the end of May.

Everything goes well even in this Corona time, the thing is that I found another ausbildung as Friseur with pretty good salary (comparing to average) and I’m really interested in Hair dresser. Before I got the work contract for Hotelfach I also looking for ausbildung as Hairdresser but the salary was too low so I gave up. But now with this opportunity I’m hesitate to change my ausbildung.

I will have an interview in couple days, and if it goes well they will let me do 2 trial days, and then if we both are happy with each other then the new ausbildung contract should be next process.

I know it’s probably a bit too soon to ask but I want to know it just in case.

My questions are;

1.) I don’t have residence permit yet, at the moment I’m holding Fiktionbescheinigung (was about to have appointment  for the permit, but with the Corona they can only Bescheinigung to extend Fiktionbescheinigung I have until they’re open and give me new appointment again) and this Fiktionbescheinigung is for ausbildung for hotelfachfrau. What if I want to change to Friseur? Do I need to write them an email or what could I do if I want to terminate my current contract when it’s still probezeit, but Ausländerbehörde still closed?

2.) Do I have to contact Bundesagentur für Arbeit and give then the new Stellenbeschreibung for the new Ausbildung place? Or it’s okay to just hand the new Ausbildungsvertrag when I have the appointment with Ausländerbehörde?

3.) I know normally Ausbildung start again around August-September, is it possible if I start in June right away if my new Employer agreed? because if I terminate the contract with my current company at the end of May, I will have nothing to do. If I only have to wait until August or September, would it be better to terminate the contract with my current employer later, like in June or July with 4 weeks noticed informed?

I know it’s probably complicated and I really appreciate that you read it all until here. Would be really greatful if you could answer my questions.

Hello @iffeve,

thank you for sharing your question with the Wefugees community.

You can change your apprenticeship, but it is very important to comply with the correct order.

If you apply for changing your apprenticeship, the current apprenticeship will and automatically and you will lose your residence permit.

So you should pursue your current apprenticeship and try to get the new contract in the meantime. When you obtain it, you send it to the immigration office and apply for a new "Ausbildungsduldung". You have to stay in your cuurent apprenticeship until you receive the new permit and give notice to your current employer only then. Also take care of the notice periods which are written in your contract.

Another important point: You have to make sure that the beginning of your new contract is the beginning of your new vocational training, that is, that you're also registered in the vocational training school by then. As you already mentioned, vocational training normally starts in September. If the new employer wants you to start earlier, make sure that these months before September aren't just a kind of internship.
