My spouse has psychological issues and I don't have physical proof on this. How can I prove to the court that my spouse has psychological problems which is why I need to get divorced from him ?.

Dear @MAGMAM

Thank you for reaching out to the Wefugees community!

I am not an expert on marriage/divorce rules and regulations. But in Germany, as far as I know, you would need to live one year in separation, before you can get divorced in court. If your spouse is not agreeing on the divorce, the court will delay the sentence and you might need to wait for 3 years. After that period, you can get divorced even if the partner doesn’t give the consent. I have my doubts, that psychological illness (unless you are i.e. in physical danger) will be a relevant point for an earlier decision.

To be sure, you might need to contact a specialized lawyer.

All the best,

Meike
