Hi,

I have a question regarding Ausbildung Work/Residence Permit. I am doing an Ausbildung for a Sozialpflege and one year has been finished already. I have just one more year to study and next year July-2020, I will get my Abschluss Certificate for Ausbildung.

So, the question is - For how long the residence/work permit I will get? Also, I have a wife and 1 year old child and can they also switch to the residence permit?

We had applied asylum  3 years ago but we never had anything from the BAMF. They never said, Yes or No to us.

What will happened with the asylum procedure if I switch to the Ausbildung?

I would really appreciate if I get the answers of the above asked questions.

Dear @Roger123

Thank you for sharing your situation with the Wefugee Community! 

First of all, congratulations for your Ausbildung! People working in the field of "Sozialpflege" are really needed in Germany. Secondly, and as far as I understand your case, it is not necessary to take the asylum application back in order to continue your Ausbildung. If you are talking about "switching" to Ausbildung, are you referring to the so-called "Ausbildungsduldung"? If yes, you could still ask for that after your case finally got rejected by the BAMF (and if you are not from a so-called "safe country of origin" having entered the country after the 31.8.15). However, depending on the region in Germany you are staying, the authorities might act very differently in terms of issuing the same kind of "Duldung" to family members. 

From January 2020 onwards, there will also be the option to apply for a "Beschäftigungsduldung" in case your asylum application will be rejected. 

The asylum procedure sometimes takes that long, indeed, and some people unfortunately need to have a lot of patience.

Thank you so much for your reply. I have received letter from Landrasamt that my asylum has been finished and I have to provide them my passport. As I did apply an Ausbildungduldung through my Solictor. But, they didn’t mention this in that letter. They said, you’ve applied your asylum and now it’s finished and you’ve to provide your passport. So, we can arrange your deportation and I do not understand that how can they ignore regarding my Ausbildung.

I have already finished 1 years and this is the second and last year of my Ausbildung - just 8 months to go and I will have my Abschluss Prüfung and will get my certificate.

My Ausbildung called Sozialpflege - staatlich geprüfte Ausbildung. I’ve applied for the passport already and I’ve evidence to show the Ausländerbehorde.

So, the main question is that can they deport me? Will they ignore my Ausbildung Platz?
Or what can I do to prevent this?
