Hello everyone,

I live in a Gemeinschaftsunterkünfte in upper Bavaria, a one room with a space of less than 15 square meter , the room is poorly ventilated and I have difficulties breathing while I'm sleeping due to a medical condition.

The house operator wants to force someone else to stay in my room without my consent, they tried to make me sign that I accept a stranger to stay in my room but I refused to sign on anything.

My question is: can the house management force me to live with someone else in these conditions (mainly the space and my medicalcondition )? Isn't that overcrowding and compulsory co habitation ? Is there's a law that governs my rights in a collective accommodation (Gemeinschaftsunterkünfte) ?and what would be a suitable action to protect my self in this case?

sadly the gemeinschaftsunterkünfte are not known for humane conditions. they put my family of 3 people in one room and forced us to live like that and there was another 5 people family in the other room. if you can get any sort of medical certificate for your issues they may allow you to change to a different gemeinschaftsunterkunft within the same landkreis. because usually rooms are meant to be shared to cut down on costs. they dont care about human rights, i am sorry. i really suggest you to go find a job as soon as you can and start working legally, in 3 months you can move out to your own private apartment or private room. i do not suggest that you stay in the gemeinschaftsunterkunft.

First of all, I'm sorry that you find yourself in a difficult situation. Unfortunately, accommodation for asylum seekers or tolerated people (holding a so-called "Duldung") in the "Gemeinschaftsunterkünfte" is often not very comfortable and very stressful for the residents.

I'm afraid it won't be easy to convince the authorities that your current accommodation is unacceptable/unbearable. I would recommend that you seek support from social services ("Sozialdienst" in your accomodation) or an advice center (you may find one close-by using this search engine). In order to be able to claim medical reasons for a change of accommodation, you will need a detailed medical certificate. If I understand correctly, you will need to submit a transfer application to the government reception center in Upper Bavaria (attaching your medical certificate). You can find the relevant form on this website.

However, I would also like to follow up and ask whether you managed to obtain the residence permit according to section 25b after you were holding the so-called "Chancen-Aufenthaltsrecht" (§104c)? If that's the case, you can move into a private apartment, or rather, you should. Are you currently working?
