Hello, if I don’t have Duldung yet still I can apply for full residence permit under a paragraph 16g? I have Ausbildung place which pays more than 1000 ,B1 German and state recognised Hochschulstudium. as I know payment is also important thing noted in new law. I am asylum seeker in Berlin with rejected case but I haven’t had court yet I have appealed already last year October. Or what can be the reason I can get rejected for Ausbildung? Thank you for your time and help and if you would have any advice I would gladly take it.

Hello dear @Anna717,

thank you for sharing your question with the Wefugees Community.

I presume, you currently have an Aufenthaltsgestattung. With this type of temporary residence permit, your asylum case is still in the process.

One of the main criteria of having a residence permit based on paragraph 16g is that you must either have started your Ausbildung during your asylum procedure and you currently have a Duldung, or you must have already had a Duldung for 3 months.

So, unfortunately you cannot get a residence permit based on paragraph 16g of the Residence Act of Germany with your Aufenthaltsgestattung. However, the good news for you is that, if you get a negative answer from the court and get a Duldung, then you can apply for and get a residence permit based on 16g of the Residence Act of Germany. Of course, if you complete all its requirements.
