How can I extend my residence permit after the seperation of my German partner /expecting a child from my new partner?

I'm married to German. We have been together in germany for close to 3 years. We had our issues and she asked me to leave the house. We have been separated and in this time space, i met a girl, who got pregnant for me. We are expecting the child soon. Can i extend my stay here with the status of my child even my child refuses to go extend my stay with our marriage status?

Hi. Just to respond anything you do during your separation and before the divorce is legally binding it will give you problems. Rushing to get another woman pregnant that quickly raises a lot of question eg sham marriage. Get a family lawyer.

What about in the situation where by, the wife asked the man to leave the house?. And facing abuse from the woman?

Based on the information you share, you may not be able to obtain an independent residence permit related to your marriage with a German citizen as you don't seem to have lived together as married couple for minimum three years. Whether it is possible to receive a residence permit as father of a child in Germany depends on several factors. If your child is German, you may be able to receive a residence permit according to section 28 of the German Residence Act (similar to your current residence permit). If your child is a third country national (non-EU), for instance, it may be a bit more complicated. Please see this thread for more information on this.

In any case, I highly recommend you to get some individual counselling in a migration counselling office or by a lawyer.
