Dear Wefugees Team,

I would like to know which categories of residence permit in Germany does section 25b abs.1 s.1 falls under? Yes of course it's for humanitarian reasons, but doesn't fall under recognized Asylum status, not refugee status, not subsidary protection and not ban on deportation.
I am asking this question because I want to apply for a permanent resident permit,
but if I know which categories of residence permit it belongs to.
I have been in my current employment for the past six years, and I also did one and half years vocational training school as assistant nurse, I have telc B2 language certificate.
I fullfil all the requirements for the granting of permanent resident permit except the 5 years of holding the limited residence permit.
I learned that if I belong to one of the above mentioned group I could be eligible to apply. Would you please be nice to give me some clear details.

Thank you in advance and hope to hear from you soon.

Best wishes

Dear Great Man,

Welcome back to the Wefugees Community and thank you for reaching out to us again!

We discussed the requirements of the permanent residence (Niederlassungserlaubnis) when holding a residence permit according to 25b here before. For you the "general" requirements of the Niederlassungserlaubnis apply - which means that you need to hold the temporary residence permit for minimum 5 years. Unfortunately, the times with "Duldung" or "Aufenthaltsgestattung" do no count.

I hope this helps to clarify your questions and please don't hesitate to get back to us again.

All the best,

Meike

Hello Meike,
Thank you for your in depth explanation.
Could you please clarify my first question ? as to whether section 25b belongs to one of the following humanitarian grounds:
* Subsidary protection
* ban on deportation
or what's it exactly?

Thanks
Dear Great Man,
No it does not belong to one of these humanitarian residence permits, which are granted by the BAMF if you are i.e. in danger in your home country or can not return for any humanitarian reasons.
The 25b was introduced to give people a chance who have been living in Germany with a "Duldung" for many years and who integrated well. In German we say "Bleiberechtsregelung".
I hope this answers your question.
Best,

Meike
