I’m married to a eu women from 4 years 4 months already I have a child that’s almost 4 year old have German nationality now my wife go back to her country with my child because of having problems with youth welfare office she left Germany and go to poland we are not separated and we don’t have any plans to divorce at all it’s just problems she must go to poland with my child and my permission I work full time all these 4 years 3 months I’m in Germany and I have resident permit from 4 years 3 months already now my wife don’t live here with me so I already nails and told Auslanderbehorde about this condition and I have papers for Abmeldung for my child and wife now still Auslanderbehorde don’t answer me they said they will contact me but surely they are busy and I know they will contact me I’m just curious if In my care when I’m already married 4 years 5 months and legally reading since 4 years and 3 months plus having 4 years old German child and have a good job will they give me another resident permit or I must consult a lawyer or they will alone give me permission to stay and continue with my life plus what could they ask for and between all this I have b1 zertifikat and Leben nach Deutschland Zertifikate too if I can ask them directly for neiderlassungerlaubnis or what am I suppose to do in this condition. I will be thank Full very much for a good positive answer

Dear @Musawvir ,

Based on my understanding of your situation, you are entitled to a permit based on having been married to an EU citizen for at least three years and at least one of these years in Germany. For such cases, if you are working, you retain your residency rights after your family members leave Germany.

The relevant legal basis for this is paragraph 3, section 4, part 1 of the freedom of movement law (here via online translation):

Permanent residency is generally only possible after 5 years. In some cases, for example if you are working in a skilled profession, the time required is less.

• A biometric passport photo no older than 6 months • Confirmation from your health insurance (Krankenkasse) that you are insured by them. You need to ask your Krankenkasse for a ‘Mitgliedsbescheinigung’ • Proof of sufficient income, most commonly by providing payslips from work • Proof of family relationship • Valid passport • Fee for the permit

From your original question it is not clear to me on which grounds you are applying to renew your permit. You mentioned having a German child. If this is the case, you many now be entitled to permanent residency according to paragraph 28, section 2 of the Residence Act:

This would depend on you having custody rights with this child (Sorgerecht). The Ausländerbehörde will also **** at what child maintenance obligations you have and whether these are being fulfilled.

From my understanding of your case, therefore, I see you either being entitled to a regular residence permit based on EU law or permanent residency based on German law. I advise you to be clear as to whether you fulfil the requirements for permanent residency already due to having a German child.
