Please sir, I need advice. 2014 I came to Deutschland, I took Asyl 12.12.2014, 2017 my name was mention on a crime in France which I have to go an clarify myself. It took me 7 months in France to clarify myself with the France Authorities after then, I travel back to Germany, During this time I went to France, my Asylum was still going on,at that time i was getting social Benefit, when i was in France, the government was paying for my flat,I did my first interview 2016, I was rejected, I then make appeal, 2020 I went to court for my Appeal, it was also rejected, I didn't re appeal I was given 3 months Duldung because I was working. I having been working for the past 3years, my monthly payments Netto is 2,000euro. I have my Leben in Deutschland certificate, I have my A2 certificate,I have my country passport, i have unbriefested arbeitetvetrag, I have my flat which I pay every month. I applied for paragraph 25b, stating that I have live here for 8years, but the government are telling me i re enter Germany for 2017. that my stay is not upto 8years. This is where I am really confused. Please I need advice

Dear Godstime 1982,

The law for 25b states that the person must have spent at least 8 years uninterrupted living in Germany with an Aufenthaltsgestattung or a Duldung. In your case, your stay here was interrupted and so the time starts from 2017.

You will, however, be entitled to a one-year permit under the new ‘Chancen-Aufenthalt’ scheme. After a year with this you will be be entitled to a permit under 25b.
