Hello,

I am holding Aufenthaltsgestattung for over 2 years now and my asylum application has been rejected by BAMF and from the court once. I got a job offer to work remotely for a foreign company outside EU. Am I allow to take the offer and pay the tax so that I don't need to take any help from sozialamt? May I know what is the process if I am to take this offer. thank you.

Regards,

Eric

Dear @Eric2020

Welcome to the Wefugees Community and thank you for your question. For now I don’t see a reason why you could not work for a company outside of the EU. But I am also not an expert in this field.

The easiest way might be to contact the immigration office (Ausländerbehörde) directly and present the job offer. They might need to agree anyway regarding a job.

Dear @mbe-on_Zsigó or @mbeon-Ruth, do you have any idea on this?

All the best,

Meike

Dear @Eric2020,

I agree with Meike that you must contact the Ausländerbehörde in any case. But I think they won't allow you to leave germany while you're still in the asylum process. Aufenthaltsgestattung means that Germany allows you to stay for the time of your asylum case, but it does not include the right to travel/work abroad. So just ask them about the job offer, but I'm not very optimistic...

It's a very interesting question any way! Thank you for sharing it with our community!

Regards

Ruth

Dear @mbeon-Ruth, many thanks for your quick reply! Yes, I also agree that he will probably not allowed to travel abroad. But as he mentioned remote work, there might be an option. Good luck @Eric2020 and please feel free to give us an update! :-) All the best, Meike

Thank you everyone for your comments. I am now trying to submit the application to Ausländerbehörde with my job offer contract. I don't actually need to travel outside of Germany since it is an IT job. I just need to work online remotely from home office and support the customer in Germany if they have any. I just hope that they would allow me to take this offer to work remotely. I will keep my fingers crossed.

Best regards,

Eric

Dear @Eric2020

I have read your question and decided to try to answer your question, but I am no specialist in this field too. This is a question on the tax office, they can surely answer your question.

I have found the following thing on the Internet about the foreign domiciled employers:

Foreign-domiciled employers

The main thing is, that you work for a foreign company, but pay taxes for Germany. In this case it should not be a problem. But I ask you to contact the tax ofiice (Finanzamt).
I hope you can find a right answer and if you have, please share it in the community, so that others could profit from your experience.
Kind regards,
you mbe-om councelor
