Hi

I got my son last week my girlfriend is german citizen and i am from pakistan having Duldung in germany. I have given the Standesamt my birth certificate from pakistan but they are not making the birth certificate for my son and secondly how can i apply for Aufenthalterlaubnis  while they say to me that i must go to my home country and apply gor a family union visa and come.

My question what can i do to make the birth certificate and how i can get the Aufenthalterlaubnis i live in bayern.

Dear Sonu,

thank you for sharing your question with the wefugees community.

Is your identity cleared? Did you submit the necessary documents to Standesamt? Why are they refusing the birth certificate? I guess you already did "vaterschaftsanerkennung". If they refuse to hand out the birth certificate you can ask for an "Auszug aus dem Geburtenregister" (Extract from the birth registry) which is almost as good as a birth certificate. 

Regarding the Aufenthaltserlaubnis: The Ausländeramt has "Ermessensspielraum" (discretion) whether to allow you to apply for the residence permit in Germany or to sent you back to apply from your Home country. If the lack of a passport is the reason for your Duldung it would be a good idea to discuss your case with a local migration counselling organization/ migration lawyer (especially if you possess a passport/ are able to organize one but you are afraid of deportation if you hand your passport in).

I have almost the same issue but I have my child birth certificate but he's mum is from England and my son is holding the British passport here in Germany.. I want to apply for resident permit will they likely ask me to go back? my identity is clear my passport is with the foreign office
