Hi Sir/ Madam

My name is Mehmood, i had applied asylum in Germany 8 months ago but i got rejected and i left Germany and came to France without filing any appeal. Now here in France i m in dublin procedure and authorities in France want to send me back to Germany because of Dublin III regulation. My question is that if i will be allowed to file appeal or file a new asylum case in Germany or they will deport me back to my home country? I have a chronic illness and i was under treatment in Germany. Can i get any visa for my treatment in Germany? Please give me some advise i will be thankfull.

Dear @Mehmood88

thank you for sharing your question with the Wefugees Community!

You won´t be able to file an appeal since the time frame for that already expired, but you could file a so called "Folgeantrag". But just to let you know - BAMF won´t check your asylum claim as detailed as it did it with your first claim. It will only see if any NEW reasons did suddenly appear for you to not go back. So the chances are not too good. Besides from that it could be possible for you to receive some sort of deportation ban or a Duldung. If you have any diseases it is important that they can´t be treated in your homecountry or only with a lot of money, that you don´t have etc.

But it probably will be crucial for you to have an asylum lawyer in Germany to help you with your Folgeantrag, since the chances are not too good. If you don´t have a lawyer, you could start with going to a free counselling centre for a first impression. They can maybe also recommend you a good lawyer close to you: https://adressen.asyl.net/language/en/welcome-to-informationnetwork-asylum-and-migration/

I hope this answer was helpful for you! Please don´t hesitate getting back to the Wefugees Community if you have further questions!

All the best

Hi, well, I will also say it depends on the region, because what I observed is, different region operates on different rules and policies, it's better to check which region is less strict and try to contact a lawyer, so you can file and asylum application.thanks
