Is there any new good news for us from traffic light coalition. I heard residence permit after 5 year and if new kid born after 5 years in germany can apply for citizenship. Is that true? Please help us with official source

Dear @Coop,

Welcome back to the Wefugees Community and thank you for opening this important topic!

Indeed, the so-called traffic-light coalition (referring to the colours representing the three parties) is planning to introduce many positive changes and improvements in residence law and asylum regulations.  PRO ASYL presents the most important points very well on their website. The source is in German though. Here you can read, for instance, that people may apply for a permanent residence permit (Niederlassungserlaubnis) after three years of holding a temporary residence permit and for the German citizenship after 5 years. As far as I understood, children born in Germany may get the German citizenship if one parent is staying regulary in Germany since 5 years. The Dual citizenship will be introduced (so far only applicable for EU citizens, for instance) as well.

Infomigrants published an article in English, also mentioning some of these aspects.

Regarding your individual situation being enrolled in an Ausbildung and still waiting for the asylum procedure result: The so-called "Ausbildungduldung" for rejected asylum seekers may turn into a residence permit.

I hope this helps and please don't hesitate to get back to us with any further questions.

All the best,

Meike

Hi Meike, I have a question you said the new rule says peopel can apply for permanent residency after three years holding temporary residence permit,. I had been living in Germany with student temporary since 2018 unti julyl 2021 then applied for asylum. Are my legal years counted for permenanet residence permit ? can I appply for it and take my asylum back?
Dear @Jeddy, Thank you for getting back to us. However, we can not give an answer yet on this detailed question, as all these 'plans' by the new government are neither approved nor implemented yet. I am afraid that we have to wait a bit more and to study potential new laws carefully before we can give proufound and reliable answers in this regard. I am sorry that I can not add much more for the time being. In any case, please don't hesitate to get back to us as soon as new laws are eventually formulated and approved or if you have any further questions. All the best, Meike
