As for your question:
1. Please address the lawyer with your fear and ask him for a copy of the appeal he has send to the court(he/she has to give it to you).
2. The court might decide against the Eilverfahren but not against the appeal itself. The courts are open for explainations so if something did go wrong and it was not your fault then please address this to the court.
Do not fear(even if it is difficult right now) address your questions with your lawyer.
