<title>No response from Ausländerbehörde on §28 application father of a German citizen</title>

<description>Good afternoon to everyone, &lt;br /&gt;
please i really need an advice on my case, i applied for a residence permit under §28 as father of a German citizen since 19th Nov 2025 with complete documents till today no response from immigration office and i also sent reminders via email, contact form on January 15th and post with Einschreiben mit Unterschrift on 9th February still no response from them i has no criminal or fine record, my asylum is pending at administrative court which can not stop them from issuing the permit because §10 no1 said so because is a entitlement permit my girlfriend signed a written statement on how i care for my child which proof that I'm taking care of my child. My problem is no rejection, approve or response from them, i has B1 living in Germany certificate. &lt;br /&gt;
&lt;br /&gt;
I don't know file a lawsuit is good idea now?</description>

I would like to ask this pressing question on my mind.&lt;br /&gt;
What happens if I have already applied for Einbürgerung in one Bundesland or city and then I moved to another city or Bundesland in between?&lt;br /&gt;
will I have to restart the whole process all over again or my file will be transferred to the authority of my new place of residence?&lt;br /&gt;

I’m writing on behalf of a friend who has been living in Germany for six years under subsidiary protection. Today, she received a letter from BAMF informing her that her case is under review as part of the Widerrufs- / Rücknahmeverfahren (Revocation or Withdrawal Procedure).&lt;br /&gt;
However, the letter does not include a date or time for an interview, which has left her confused and concerned.&lt;br /&gt;
We would appreciate clarification on the following points:&lt;br /&gt;
&lt;br /&gt;
1. Why would BAMF initiate a review after 6 years?&lt;br /&gt;
She has not committed any crimes.&lt;br /&gt;
She has never returned to her home country.&lt;br /&gt;
She has passed her B1 language exam and has started her own business in Germany.&lt;br /&gt;
She has a family, including two children—one of whom was born in Germany last year.&lt;br /&gt;
2. What could trigger this kind of review, and what should she expect during the process?&lt;br /&gt;
3. What are the chances of her protection status being revoked or maintained under such circumstances?&lt;br /&gt;
4. Is it necessary or recommended for her to consult with a lawyer immediately?&lt;br /&gt;
Any guidance you can provide would be greatly appreciated, as this situation is causing a great deal of stress and uncertainty.&lt;br /&gt;

I lived in Germany about 4 years ago, I applied for asylum but it was rejected first from BAMF then from the Court,so assulander Behorde asked me to leave the country, but I over stayed there with cross on my ausweise(Doldung).&lt;br /&gt;
&lt;br /&gt;
&amp;nbsp;after few months I left from Germany and moved to france and got asylum and got réfugiés status and 10 years Carte Sejour.&lt;br /&gt;
&lt;br /&gt;
Recently I travelled to Germany, and got checked by borders police while travelling to Germany, they asked for my address and let me entered Germany.&lt;br /&gt;
&lt;br /&gt;
Now after a month I got a letter from the German Court I think, they told me that I over stayed in Germany 4 years ago. I have come to Court to face the judgment with my lawyer, if I not come they will issue one sided decision without further appeal.&lt;br /&gt;
&lt;br /&gt;
The act on the letter is written:&lt;br /&gt;
Mr.(my name) for an offence under Section 95 Paragraph 1 No. 1 of the Residence Act&lt;br /&gt;
&lt;br /&gt;
Please tell me how to solve this issue, will they arrest me or fine me if I don't appear to court, and I got réfugiés status with réfugiés passport in france.</description>

&lt;br /&gt;
Hello ich habe eine Frage im Zusammenhang mit den §§ 10 Abs. 3 und 18a des Aufenthaltsgesetzes&lt;br /&gt;
&lt;br /&gt;
Der Originaltext lautet&lt;br /&gt;
&lt;br /&gt;
3) Einem Ausländer, dessen Asylantrag unanfechtbar abgelehnt worden ist oder der seinen Asylantrag zurückgenommen hat, darf vor der Ausreise ein Aufenthaltstitel nur nach Maßgabe des Abschnitts 5 erteilt werden. Sofern der Asylantrag nach § 30 Absatz 1 Nummer 3 bis 7 des Asylgesetzes abgelehnt wurde, darf vor der Ausreise kein Aufenthaltstitel erteilt werden. Die Sätze 1 und 2 finden im Falle eines Anspruchs auf Erteilung eines Aufenthaltstitels keine Anwendung; Satz 2 ist ferner nicht anzuwenden, wenn der Ausländer die Voraussetzungen für die Erteilung einer Aufenthaltserlaubnis nach § 25 Absatz 3 erfüllt. Ein Aufenthaltstitel nach § 18a, § 18b oder § 19c Absatz 2 darf einem Ausländer, dessen Asylantrag unanfechtbar abgelehnt worden ist, vor der Ausreise nicht erteilt werden. Einem Ausländer, der seinen Asylantrag zurückgenommen hat, darf vor der Ausreise ein Aufenthaltstitel nach § 18a, § 18b oder § 19c Absatz 2 nur erteilt werden, wenn er vor dem 29. März 2023 eingereist ist; Gleiches gilt für die Erteilung einer Aufenthaltserlaubnis nach Maßgabe des Abschnitts 6 an den Ehegatten und das minderjährige ledige Kind des Ausländers.&lt;br /&gt;
&lt;br /&gt;
So habe ich es verstanden, aber ich bin mir nicht sicher, ob ich es richtig verstanden habe.&lt;br /&gt;
&lt;br /&gt;
Wenn Menschen den öffensichtlichen unbegründeten Asylbescheid bekommen.&lt;br /&gt;
&lt;br /&gt;
Und dann ist der gerichtliche Eilantrag erfolgreich, das heißt, der Fall wird vom Gericht übernommen, und im gerichtlichen Asylverfahren, wenn die Person eine mindestens zweijährige Ausbildung absolviert hat und eine IHK-Bescheinigung von erfolgter Abschluss erhalten hat, dann kann der Antrag zurückgenommen und direkt nach 18a Aufenhaltenlaubnis bewilligt werden. Richtig ?&lt;br /&gt;
&lt;br /&gt;
Und wenn man eine mindestens zweijährige Ausbildung absolviert, kann ich das verstehen, solange es sich um eine zwei Jahre &amp;nbsp;Ausbildung handelt, ja? So muss mann nicht 3 Jahre Ausbildung probieren&lt;br /&gt;
&amp;nbsp;Ich habe auch festgestellt, dass 18A nicht so viele Zusatzklauseln hat wie 19D.&lt;br /&gt;
&amp;nbsp;Duldung ,Unterbringung, deutsche Sprachvoraussetzungen.&lt;br /&gt;
&lt;br /&gt;
Ich wünschte, ich hätte jemanden, der mir bei der Beantwortung dieser Frage hilft, denn bekommen ich eine Ausbildung ,das ist nicht einfach&lt;br /&gt;
&lt;br /&gt;
Das bedeutet, dass es normalerweise bei einer 7-Tage-Entscheidung überhaupt keine Aufenthaltserlaubnis nach 10(3) des Aufenthaltsgesetzes geben kann, weil es jede aufenthaltsgewährende Sperrwirkung blockiert, aber wenn das Gericht den Antrag annimmt, läuft der Asylantrag noch weiter, was bedeutet, dass die endgültige Entscheidung in der Angelegenheit noch nicht feststeht, und wenn ich mein Asyl zurückziehe, das die Ausbildung abgeschlossen hat&lt;br /&gt;
Das bedeutet, dass die Sperrwirkung für mich nicht gilt, richtig?&lt;br /&gt;
&lt;br /&gt;
Außerdem sind nicht einmal so viele Anforderungen wie für den 19d erforderlich, es reicht ein IHK-Ausbildungsnachweis aus.&lt;br /&gt;
&amp;nbsp;So habe ich das verstanden, denn nur so kann ich mir das vorstellen.&lt;br /&gt;
&lt;br /&gt;

I am planning to travel to Hong Kong with a layover in Frankfurt. My intention is to apply for asylum at the Frankfurt airport. Upon departure from Cairo, I plan to publicly declare my atheism via a social media post to substantiate my case and highlight the risk of persecution I face if I return to Egypt.&lt;br /&gt;

<title>Changing from spouse permit to 25b</title>

<description>My partner was on the 18 month Chancenaufenthaltserlaubnis 104c and had fulfilled all the requirements to move to a 25b. We got married and instead of the 25b, they moved on to a family member of EU citizen residence permit. I now want to leave the country and we may divorce, but we have been married for less than 3 years. Is it possible for them to move back to the original route and switch to a 25b. They have full time employment, but I don't think it fulfills the requirements for a skilled employment visa. Effectively am I trapped here for another year or so until they have independent right to reside without me or is it possible to jump to 25b from anything other than 104c or a Duldung?</description>

<description>I am from Turkey, after the earthquake and the final election in 2023, seeing how people were violently celebrating, and several attacks I have survived in the final 2 years made it too stressful to handle, there is of course details to my reasonings- so I immigrated to Sweden judging as a humanitarian country but I am deeply disappointed in 2 years I've spent here. I got assaulted twice by 2 different people one of them was a police officer, both of the cases did not get to court under rape crime. Once there was concrete proof. For the police officer the police decided that my claims were innaccurate and the investigation stopped. &amp;nbsp;When my first asylum application was rejected- i appealed by adding new grounds like my sexual identity. It was rejected again, i appealed again with more documents regarding my mental health. I don't feel safe in sweden anymore to begin with, i want to immigrate and study in Germany. The years i've been here took away from my life, i tried everything to work but it's impossible to get a tax number. Studies are too expensive. In germany i am eligible to study on case by case decision. I acknowledge the dublin rules. But I cannot go back to Turkey or Sweden. Help me please.</description>

I’m concerned that these unfilled sections might cause problems with my visa extension. My residence permit is set to expire on 24th October 2024, and I want to ensure I have all the necessary documentation.&lt;br /&gt;

Has anyone faced a similar issue with an incomplete Bestätigung der Bildungseinrichtung? How can I ensure that the Ausländerbehörde will accept the document, or is there any way to resolve this before my permit expires?&lt;br /&gt;

<description>I recently got diagnosed with vasovagal syncope in the emergency room. Its basically losing consciousness in the case of certain triggers and the thing that triggered my vasovagal episode was poor ventilation and being in a crowded area. This didnt happen in my room at the GU but i have been very close to getting episodes before i got diagnosed and in fact fainted in my room once before too. I just didnt know what it was and assumed it was anemia so I didnt think too much of it. Ventilation here is also horrible (in the toilet i can smell the kitchen from the upper floor, and sometimes their toilet its gross and windows dont help much when the inner ventilation is like this. overall its a moldy and clammy flat) and its crowded. Is it possible to get my wohnsitzauflage removed with this? I just have a paper of my diagnosis from the ER and what happened to me that day. Do i need to explain authorities my illness? Ich weiß schon, wenn der Antragsteller eine Ausbildungsduldung beantragen will, kann er sie im Voraus beantragen, aber die ABH wird die Dokumente nicht für ihn ändern, weil der Antragsteller die Aufenthaltsgestattung genommen hat, um in Deutschland eine Ausbildung zu machen, und das ist genug, aber ich verstehe ein Detail nicht, mein Pass ist jetzt in den Händen der ABH, und wenn ich vom Bamf abgelehnt werde und das Bamf mich innerhalb von 30 Tagen ausreisen lässt, kann ich während der Berufungsfrist eine Ausbildung beantragen, oder nicht? Wenn mein derzeitiger Pass in den Händen der ABH ist, wenn er vom Bamf abgelehnt wird und das Bamf mir 30 Tage Zeit gibt, um auszureisen, kann ich während der Berufungsfrist vor Gericht eine Ausbildung beantragen, oder? Im Gerichtsverfahren bewerbe ich &amp;nbsp;eine Ausbildung ?Nur die ABH wird mich nicht in eine Ausbildungsduldung umtauschen, weil ich eine Aufenthaltsgestattung habe, die ich erst umtauschen kann, wenn alle Asylverfahren abgeschlossen sind. Wenn die Gerichtverfahren fertig gemacht haben&lt;br /&gt;
Zweitens weiß ich bereits von der 3+2-Regel für Deutschland, wenn ich also eine zweijährige Ausbildung beantrage, ist das auch möglich, oder? Denn ein teil Ausbildung hat 3jahre und ein teil Ausbildung ist 2 Jahre&lt;br /&gt;
Drittens, das ist meine größte Sorge, mein Pass wird am 02.2026 ablaufen, wenn ich meine Ausbildung erfolgreich abschließe und mein IHK Prüfungszeugnis bekomme, muss ich meine Ausbildungsgeduldung gegen eine Aufenthaltserlaubnis eintauschen, aber mein Pass muss bis dahin abgelaufen sein, wenn ich zur Botschaft in meinem Heimatland gehe, werde ich meinen Pass nicht umtauschen können, weil sie auf jeden Fall meinen deutschen Aufenthaltmittel wollen. Aber das Problem ist, dass ich ohne einen gültigen Pass keine Möglichkeit habe, diesen gegen eine deutsche Aufenthaltsgenehmigung von ABH einzutauschen, und das ist ein Problem, bei dem ich Sie fragen möchte, wie Sie es gelöst haben</description>

Disappointed, I decided to enroll in another school in Germany starting in October 2023. Upon arriving, I submitted my study progress from the online school and the enrollment for the new school to the Ausländerbehörde (Foreigners' Office), but was granted a residence permit for the course I had been doing online instead. I graduated from the online course on July 19, 2024, and am now unsure whether to submit my graduation documents to the Ausländerbehörde to get a post-study work visa but I am just skeptical because I heard that they may not grant it because the course was online, and I might need to complete my on-campus studies first, which would be stressful. What should I do or is there something I can do legally to make me get the post study work visa, as now studying to complete the on campus is a bit stressful </description>

Once he signed the contract, the company submitted his documents for approval from the Ausländerbehörde. According to the Ausländerbehörde, he can start working once he receives approval. Then he rented his own apartment.City registration has been completed.A bank account has been opened.AOK health insurance has been arranged.A tax number has also been obtained.He has already worked for three months and social contributions have been made. Recently, his visa processing agent said the visa will be rejected because he has a work permit.Given that he has come this far, having a genuine job offer and a signed work contract, is there any way he can still obtain approval?Should he wait for a formal rejection from the Ausländerbehörde?In case of rejection, can he apply for a job-seeking visa from the Italian embassy?What if he finds another job contract that qualifies for the Blue Card?Is there any chance for him to apply for a &amp;quot;Chancen Karte&amp;quot; in June? He holds a valid Italian work permit and is also learning German..</description>

<title>Can I re-enter Germany ?</title>

On September 19, 2022, I traveled from Germany to Denmark as a tourist. Unfortunately, I unintentionally broke some laws in Denmark, leading to my arrest. During this period, my residence permit was still valid. Due to unforeseen circumstances, the investigation took an extended period, and I ended up spending approximately 120 days in jail. Ultimately, I was sentenced to 14 days in jail, received a ban from entering the Schengen area for six years, and was deported to Germany on April 3, 2023.&lt;br /&gt;
&lt;br /&gt;
During this deportation, my residence permit had expired, and I had to restart the process of renewing it. Fortunately, I successfully extended my student German residence permit on November 07, 2023, and it is valid for one year. Recently, On December 3, 2023, I decided to visit my homeland (a third country).&lt;br /&gt;
&lt;br /&gt;
The customs agent at Paris airport detained me for a longer time than usual when I was leaving the country. However, I eventually completed the exit process and made it to my flight on time.&lt;br /&gt;
&lt;br /&gt;
So, when I arrived to my homeland, I began to have doubts about whether my name was in the Schengen database. Consequently, I wrote to the Danish authorities. They informed me of the following:&lt;br /&gt;
&lt;br /&gt;
&amp;quot;Since you informed the Danish Repatriation Authority on February 1, 2024, that you have a valid residence permit in Germany, the Danish Repatriation Authority must consult with the German authorities pursuant to § 58 h of the Danish Aliens Act to clarify whether they will maintain or revoke your residence permit.&lt;br /&gt;
&lt;br /&gt;
If the Danish Repatriation Authority receives a decision from the German authorities stating that they will maintain your residence permit, your registration in the SIS as unwanted in the Schengen Area will be deleted, but you will continue to have a national entry in Denmark until February 1, 2029 (inclusive of this date).&lt;br /&gt;
&lt;br /&gt;
If the Danish Repatriation Authority receives a decision from the German authorities stating that they will revoke your residence permit, your registration in the SIS as unwanted in the Schengen Area will remain in effect until February 1, 2029 (inclusive of this date).&lt;br /&gt;
&lt;br /&gt;
Please send a copy of your valid residence permit to the Danish Repatriation Authority so that we can begin consultation with the German authorities.&amp;quot;&lt;br /&gt;
&lt;br /&gt;
(Four weeks passed and they did not answer me because they told me that they were waiting for the German authorities to respond)&lt;br /&gt;
&lt;br /&gt;
I contacted the Foreigners Authority, and they responded as follows:&lt;br /&gt;
&lt;br /&gt;
&amp;quot;I have not yet received any information from the Danish government that would hinder your stay in Germany.&lt;br /&gt;
&lt;br /&gt;
Since you have a residence permit for Germany, you can travel to Germany as usual. Please remember, however, that you must not stay abroad for more than 6 months, otherwise your residence permit will expire.&amp;quot;&lt;br /&gt;
&lt;br /&gt;
I'm unsure if I can enter Germany without any issues or if I will encounter problems upon entry. I'm concerned that the decision might be made there, and I fear that the German authorities may not fully understand the situation. I'm worried that they might confiscate my documents and send me back to my country.&lt;br /&gt;
&lt;br /&gt;
I'm looking for your advice and opinions.&lt;br /&gt;

Hi, Context: I am 18M and my origin is Pakistan but living in Middle East from childhood. I am right now in 12th class which is Higher Secondary School-II of Pre-engineering. I get good grades, like I got 91% in 10th.&lt;br /&gt;
&lt;br /&gt;
Main topic: My father's been working in ME from 20yrs+ and now he can see that he reaching a age of retirement and ME government forces you to retire and go back to your homecountry. Sadly we don't have much in homecountry, we have to start from scratch.&lt;br /&gt;
&lt;br /&gt;
My parents are thinking of going to Spain on visit visa and take asylum there, my father's brother is in Madrid who got his own restaurant and my father planning to work with him.&lt;br /&gt;
&lt;br /&gt;
HOWEVER, My parents want to prioritze my education first. They got necessary information regarding asylum(refugee seeking) process but sadly can't find info for education. After 12th I am planning to pursue BACHELORS IN MECHANICAL ENGINEERING. I will learn Spanish. So english education won't be necessary.&lt;br /&gt;
&lt;br /&gt;
My only question is:&lt;br /&gt;
&lt;br /&gt;
Can I as a Asylum seeker get admission in a University so that I can pursue bachelor Is degree? Thanks</description>

<description>My fiancee got suddenly in trouble with a new law in her home country Uganda, that gives jail for people having anything sexual with the same gender.&lt;br /&gt;
The quickest visa she should get was Canada, do now she flew, connecting in Brussels, to Montreal and applied there.&lt;br /&gt;
Could she revoke her application, start traveling back, again connecting in Brüssel, and apply for asylum in Belgium?&lt;br /&gt;
It would make things a lot easier, since I'm Norwegian and live in Norway.&lt;br /&gt;
Unfortunately I doubt that it is possible to just transfer her case together with her to Norway.</description>

Where do l report or get assistance the local court is mistreating and ignoring my case irregardless of providing the information needed to legally bind a document. They are racially discriminating me and taking away my freedom.The court has changed my case to 5+ people causing confusion. I have a free lawyer but she is ignorant and isn't helping. &lt;br /&gt;
