No response from Ausländerbehörde on §28 application father of a German citizen

Good afternoon to everyone,
please i really need an advice on my case, i applied for a residence permit under §28 as father of a German citizen since 19th Nov 2025 with complete documents till today no response from immigration office and i also sent reminders via email, contact form on January 15th and post with Einschreiben mit Unterschrift on 9th February still no response from them i has no criminal or fine record, my asylum is pending at administrative court which can not stop them from issuing the permit because §10 no1 said so because is a entitlement permit my girlfriend signed a written statement on how i care for my child which proof that I'm taking care of my child. My problem is no rejection, approve or response from them, i has B1 living in Germany certificate.

I don't know file a lawsuit is good idea now?

Please i applied for a residence permit under §28 as father of a German citizen on 19 Nov 2025 i submitted every necessary documents custody and Vaterschaft including my girlfriend signed statement with her ID that i has been taking care of her and my child since pregnancy and my A2 certificate and am writing B1 next month but am yet receive any feedback from immigration office, and my asylum appeal is pending at administrative court must I withdraw my asylum before my application will be process and should i send them a reminder message since is now 7 weeks and i also believe §28 is entitlement permit and i care for my child very good and i has Aufenthaltsgestattung now and am still living in asylum house but not in camp and i stated in my application statement that i want to live together with my son once the authority approve my application

However, the letter does not include a date or time for an interview, which has left her confused and concerned.

1. Why would BAMF initiate a review after 6 years?
She has not committed any crimes.

4. Is it necessary or recommended for her to consult with a lawyer immediately?
Any guidance you can provide would be greatly appreciated, as this situation is causing a great deal of stress and uncertainty.

Relocated after applying for Naturalization

What happens if I have already applied for Einbürgerung in one Bundesland or city and then I moved to another city or Bundesland in between?
will I have to restart the whole process all over again or my file will be transferred to the authority of my new place of residence?

Inquiry Regarding Eligibility for Naturalization (Einbürgerung)

arrived in Germany in December 2013 and applied for asylum.

In May 2016, I received my first negative asylum decision. I filed an appeal against this decision, and until the beginning of 2018, I held the status of Aufenthaltsgestattung.

In 2018, I was granted Duldung. After that, I received an Ausbildung (vocational training) contract, but I did not receive permission from the Landratsamt to start the training. Due to this delay, I submitted an Untätigkeitsklage (action for failure to act) to the court.

As a result, in 2019, I was granted an Ausbildungsduldung. I then submitted an application for a residence permit under §25b Aufenthaltsgesetz. This application was approved in December 2021, and I received my residence permit in February 2022.

In 2022, I successfully completed my Ausbildung.
In 2025, I applied for permanent residence (Niederlassungserlaubnis) under §26 Abs. 4 Aufenthaltsgesetz. I have now permanent residence para 26 abs 4

My question is whether I am eligible to apply for naturalization (Einbürgerung).?

What happens if l register another address without approval from BAMF

I was assigned a place to live in Celle when l came in 2022. I then got a job in Amazon close to oldenburg. I applied 4 times stating that l want to change my address and they turned me down. I continued to live in Jade unregistered. Now my wife gave birth to a beautiful daughter and the landkreis in Jade send me a letter that l have to register within 1 week or l will recieve a 1000€ penalty. I am not sure what to do. Should l proceed to register and if so what are the consequences from Bamf?

I want to ask if getting an Ausbildungsduldung with this would be possible because its a Helfer Ausbildung but its also recognized, duale Ausbildung and lasts 2 years

Hello, my Interview was in 28.03.2023 and still I don‘t have reply from BAMF, so my lawyer going to Untätigkeitsklage on next 10.11 from Administration Court in Freiburg. What can you say about my decision to put Untätigkeitsklage againt BAMF Freiburg? I have still doubt may be BAMF refuse my case because they have extra pressure from Admin court. i really cannot understand this situation. Thank you very much!!!

Please I have some questions about Dublin Cases for my partner she came from France and she had a subsidiary protection resident permit in France, But however, she relocated to Germany with the kids and Seek asylum here. However I am living in Germany with resident permit Para. 19d abs1nr 1.

Recently she got negative decision from the court to return back to France in July 2025. last week the police tried deporting her back to France, but luckily she wasn’t at her home that very day. she is now 13 weeks pregnant for me, and i have informed her lawyer about this and he requested for the Mutterpass and Vaterschaft, including a copy of my documents, then he sent them to the Foreign office.

But my fiancee can’t even sleep because she is really scared that the police will probably still come looking for her again.

We are both so much worried, Because i already rented a family apartment already and we are waiting permission from her social so she can move in officially with me.

Could someone please share their experience or advice with me.

Can they still deport her while she is already pregnant with my Child?

What are the chances of her being deported?

Struggling with overcrowded Gemeinschaftsunterkünfte

I live in a Gemeinschaftsunterkünfte in upper Bavaria, a one room with a space of less than 15 square meter , the room is poorly ventilated and I have difficulties breathing while I'm sleeping due to a medical condition.

The house operator wants to force someone else to stay in my room without my consent, they tried to make me sign that I accept a stranger to stay in my room but I refused to sign on anything.

My question is: can the house management force me to live with someone else in these conditions (mainly the space and my medicalcondition )? Isn't that overcrowding and compulsory co habitation ? Is there's a law that governs my rights in a collective accommodation (Gemeinschaftsunterkünfte) ?and what would be a suitable action to protect my self in this case?

Request for Advice regarding My Child’s Contact with His Biological Father

I am seeking your advice and assistance regarding my child’s situation. I have a son with a German citizen, who is his biological father. Unfortunately, the father has refused to have any contact with his child since birth. My son is now four years old, and his father has shown no interest in meeting or communicating with him.

We have already completed a DNA test confirming paternity. However, there has been no emotional or parental involvement from the father’s side. I have tried several times to reach out to him—asking if he could at least meet our child occasionally, even for a short visit in a public place—but he has repeatedly declined. He stated that he does not wish to see his son until the boy is grown up and able to visit him on his own.

This situation is very painful for me, as I do not want my child to grow up without knowing his father or his extended family. I am not trying to force a relationship, but I believe some minimal contact would benefit my child’s emotional well-being. Unfortunately, I do not have any family here in Germany to support me, and I am unsure what steps to take.

Could you kindly advise me on what options are available in such a case? Is there any legal or social service support that can help ensure at least limited contact between my child and his father?

I’m on fiktionbescheidung after the expiry of Resident permit 104C .Language certificate was missing on my application for Resident Permit 25b.Tried to write the A2 exam four times and I failed.Just received the exam results that I failed again.Ausländerbehode gave me until end of October to send the certificate to their offices or else my application will be rejected.How best can i handle this good people?

I have lived in Germany for almost 6 years, first with a Duldung and then with § 104c residence permit. I will, hopefully, receive the § 25b residence permit beginning of next year.

I have also been working in a STEM field with a ZAB certified degree for the past 4.5 years.

The permanent residency requirement is for the applicant to have lived in Germany with a residence permit for a minimum of 5 years.

Will the time I have spent under Duldung and § 104c count towards this requirement, or will the clock reset upon issuance of § 25b?

Hallo Meike, i would just like to say i contacted an Beraterin, and a Berater, they both just requested information from me. i sent it through and never got a response. I have been to their office to speak to them too. so its not just phone calls or anything. I have to renew my Duldung 60a this coming Tuesday and i dont know what to do. I really need help.

What the Berater told me though is that i should not file a lawsuit of inactivity on the immigration office in my landkreis as they sometimes are very difficult and since it is not my right to get the 16g and its the choice of the immigration office to make if they want to give me the residence permit, they could decide to not give it to me if i file a lawsuit of inactivity. So I have not done it.

the Beraterin told me that with my duldung i should try applying for 16a as well that she will help me with it and till date ive not heard back from her. She says based on all the documents i have, i shouldve gotten a response by now from the immigration office even if they are completely busy. but iobviously ive not gotten a response from them.

The company they work for is a big well known company hence i can not mention their name for their privacy.

Please advise on what i can do.

Hello, I want to make an enquiry, my wife/partner has a study permit in France, she came to Germany last year to give birth. She went back to the germany Consulate in france to apply for family reunification based on marriage after given birth in germany, but she was denied, so I personally contacted the ausländerbehörde to know why, they said I am a student and I was not married before coming to germany, months later I contacted a lawyer and the lawyer wrote to the immigration office in germany requesting that she should be considered for §30 abs 1 or §25 abs 5 and that my child should be given §33 abs 1 or §32 or §25 abs 5

Some months later, the ausländerbehörde gave the mother and the child a Fiktionsbescheinigung gem. § 81 Abs. 3 AufenthG, for 6 months, but before the end of that 6 months, I graduated from (IU berlin), then I went back to change to post study visa, and they gave me another § 81 Abs. 4 AufenthG but Written siehe visum and on my wife they gave her another fictionbeschingung which says Siehe französisches Visum im Pass but now with §81 abs 4, and they told both of us that we can only work 20 hours per week but if any of us get a job that could give us option to switch visa that we should come back and apply for a residence permit or if she land an Ausbildung and a few weeks later, she got a part-time job with kaufland which she has been doing since almost 6 months now, so I decided to apply for university admission for her. So we went to the ausländerbehörde last month, and they gave her appointment and what she needed to bring for the appointment next week, but here is my question:

How can this help my own situation, becuase the man at the ausländerbehörde asked me that "what about you, how do you want to do your own extensions since you haven't gotten a qualifying job for section 18 or bluecard and my response to him was that I am still searching but he should proceed with her own" We have only a few days to her appointment now, and I am wondering what what's next for me and my child on our stay. Although I am working part-time but I can ask the company to change it to full time. I need to change my status with can at least give me a residence card and not fictionbeschingung again.

Is it possible for me to change to a dependant on her, or can my work permit them to give me another residence status such as § 19 or any other.

ich besitze derzeit eine Aufenthaltserlaubnis gemäß § 25b Abs. 1 Satz 1 AufenthG.

Ich bin im August 2019 nach Deutschland eingereist und war bis Januar 2024 im Besitz einer Aufenthaltsgestattung bzw. Duldung. Seit Januar 2024 habe ich den Aufenthaltstitel nach § 25b.

Meine Ehefrau und ich haben beide die Ausbildung zum Hotelfachmann / zur Hotelfachfrau in Deutschland erfolgreich abgeschlossen (verkürzt auf 2,5 Jahre) und mit guten Ergebnissen bestanden. Wir verfügen über Deutschkenntnisse auf dem Niveau B1.

Zurzeit arbeiten wir beide in Vollzeit mit unbefristeten Arbeitsverträgen und sichern unseren Lebensunterhalt vollständig ohne Inanspruchnahme staatlicher Leistungen.

Bislang habe ich bereits 48 Monate Pflichtbeiträge in die Rentenversicherung eingezahlt.

Vor diesem Hintergrund möchte ich Sie höflich fragen, ob ich bereits jetzt die Niederlassungserlaubnis nach § 18c Abs. 1 AufenthG beantragen kann, oder ob ich bis zur Erfüllung von 60 Monaten Rentenversicherungsbeiträgen warten muss.

After changing my address (and not informing the BAMF) I received my asylum decision (too) late - What can I do?

I got a Yellow paper with my Asylum number and It says "Notification of the deposit of a document to be served." I attempted to deliver it on September 11, 2025, but I wasn't home, so I haven't seen it yet. I was in the process of moving and haven't yet finished moving my belongings from my Asylheim to the normal new apartment.

Thing is, I am doing a schulische Ausbildung and I notified Ausländerbehörde in February. I called Bamf and told them everything and they told me to send them a mail with my Mietvertrag and everything and tell them I didnt get the letter and they will resend it to me. They also dont know if i got a rejection or an approval or something else.
My issue is, what happens if i got a rejection? Will the deadline restart when they resend the letter? Today is 24.11.2025 and I found out about everything today and contacted everyone I can
Will I be facing deportation even if I miss the deadlines? Like I said, Ausländerbehörde already knows about my Ausbildung. Will I be issued an Ausbildungsduldung? I couldnt call them as today is Wednesday. Lady on the phone from Bamf told me not to worry abd explain everything in Email and I did.
I didnt report my address as soon as I was moving out because my Social Worker advised so. I deeply regret it. But now Bamf knows the new address and when I moved in

Hello all.
I came to Germany 2023 and seek for asylum which was rejected the same year and I appeal and the appeal is still pending.
I learned German quickly and secure my B1 and am now doing fachkraft for möbel, küchen und umzugsservice.
The ausbildung demands a lot of physical work and I don't have the strength to carry sofas alone up to 5,6 floor to the customer during delivery as am a very lean guy.
Now I want to change my ausbildung but first I need to secure another ausbildung before cancelling the current one so as not to risk deportation as my passport is already at the Auslanderberhöde.
My question is, is it safe to change ausbildung in my current situation? I already started my second year ausbildung but the work is literally burning me out because I don't have the strength. Can I cancel and still be safe. I want to do my B2 exams as apply for the ausbildung as Medizinische Radiologie Technology.

Section 24 AufenthG with an existing Polish temporary residence permit and medical vulnerability

Could you please advise whether I can obtain temporary protection under Section 24 of the German Residence Act in light of the following circumstances:

I left Ukraine on 17 February 2022 under the visa-free regime.
Due to the outbreak of the war, I was unable to return to Ukraine and remained in Poland, where I later obtained a temporary residence permit (based on employment).
During that period I was subjected to labour exploitation and experienced systematic discrimination.
I was diagnosed with a severe chronic illness requiring specialised treatment, which I have repeatedly been unable to access despite being employed, paying taxes, and not receiving any social benefits.
For 20 months I have been on inadequate steroid-based therapy, which may ultimately lead to disability.
Returning to Ukraine is not possible for obvious reasons.

I kindly request your assessment and advice. I have all necessary documents confirming my date of entry and my medical condition. If, in your view, I am eligible for protection under Section 24, could you also indicate which federal state would be most appropriate for me to approach? I would be grateful for any further recommendations or questions you may have.

Hallo zusammen,

ich habe im August 2025 die deutsche Staatsangehörigkeit erhalten, nachdem ich 2017 nach Deutschland kam, 2021 geheiratet und seit April 2021 durchgehend mit meiner deutschen Ehefrau zusammengelebt habe. Seit Ende 2024 befinde ich mich im Trennungsjahr und eine Scheidung steht in den nächsten 1–2 Monaten bevor. Die Ehe bestand über vier Jahre, und es liegen keinerlei behördliche Vorwürfe einer Scheinehe vor. Ich bin seit Januar 2023 selbstständig tätig.

Meine Frage ist: Kann eine Scheidung in meiner aktuellen Situation irgendeinen negativen Einfluss auf meine bereits erhaltene deutsche Staatsangehörigkeit haben, oder besteht diesbezüglich kein Risiko?

i just wanted to know. My daughter has Philippine passport but also have german residency card through me. Recently she acquired the citizenship of her Father (Bosnia). She entered Bosnia with Phil. pass and will exit Bosnia with Bosnian passport. Im kinda worrying bcoz she have different passport when entering and exiting Bosnia. I know that Bosnia is non EU and for residence of EU countries can visit there for 90 days.. My daughter will stays for 5months with her Father in Bosnia and will get back in Germany before 6 months so she would not loose her residency. Will there be a problem at Immigration of Bosnia when i show her Bosnian Passport when exiting? because of Entering Stamp from passport since its in different passport?

Once again I'm reaching out to you concerning the Einbürgerung application procedure.
I fulfilled all requirements to apply for the Einbürgerung, but
I still have one year left for me to reach the five ( 5) years residence period. In July 2026 my 5 years residence period will be completed.

But I contacted my local Ausländerbehörde to ask if I can submit my Einbürgerung application now, and the clerk from the Staatsangehörigkeit Office told me being that the process can take months or year to be processed.
I am allowed to submit my application now.
My question here is: will I have good legal standing to ask for a refund of the €255 processing fee if my application is rejected base on insufficient residence time?

After being insured with AOK for a while, I receive asylum seekers money again - Do I need to pay the insurance myself?

I did an FSJ for 6 months and i was insured by AOK Baden Württemberg during it. After my FSJ, Sozialamt said that they wont pay for my Krankenkasse contributions and Krankenkasse wants to charge me 250€ every month saying thats the least amount they can do. They said theyre gonna send something to my home so I can be voluntarily insured and agree to it. Sozialamt said they wont take the costs in a previous email saying "Breiträge für die obligatorische Anschlussversicherung werden ab 01.01.2025 nicht mehr vom Sozialamt Waldshut übernommen." i dont know if this has a legal basis because i am receiving 20,50 euro from the Bezahlkarte (Sozialamt gives me this much because i live with my mom and they believe that i get around 100 euro of child support from my dad, even though i explained to them that i cant access this money anymore due to my card being broken and not being able to contact my dad and bank who are in a foreign country they want a "written explanation from the court that i am not receiving this money" anymore. ???)
point is i cant pay this, i called aok and they said this is a political thing sozialamt is trying to do and many people are in this hard situation and we have no better option but to have debts. i cant apply for a job because we are going to move to another city with my mon (she will start working in another city and ill do an ausbildung there and we are moving to a city nearby) and my ausbildung is schulische that ill pay out of pocket for. i dont know if this has any legal reasoning, basically aok cant kick me out of the insurance because i have to be insured, sozialamt refused to cover/offer any alternatives, instead i am debted with amounts i cant pay. im really upset and i dont understand anything. NGOs wont contact me because of the city i am in, saying that the Sozialamt is responsible for there and everyone is excluding me and refusing to help

Is the period in which I held a residence acc. to §25 (5) counting for the naturalisation?

Me and my Daughter applied for Einbürgerung and its already on process but we still have some papers that needed to pass. Me and my childs Father are not living together and i mention it to the Officer in charge of our Application. The officer ask me if the Father can come during Einbürgerung and i said to him that he cannot come.
Now the question is, does the Father needed to be present during Einbürgerung of a child?
- we are not married but we have Vaterschaft and Sorgererklärung
- why does the officer pushing me to get Alleinige Sorgerecht? tho my Daughter lives with me, had her residency through me. She stays with her Dad sometimes. Were not just living together bcoz my partner doesnt have German residence Permit.
-i read that its not mandatory bcoz my daughter will be eingebürgert with me.

Urgent help with Sorgerecht issues

Please the father of my 2 children is irresponsible. Due to this, l have refused to give him 50 % Sorgerecht of our second child and l have sent him to court regarding the 50% Sorgerecht of the first child he had. Due to his constant absence, it is very difficult to reach him to sign important documents when needed and l needed to take immediate action for our unforeseen future.

My problem is, l am pleading with the court to counsel that 50% Sorgerecht that we made, so that in case of anything, any of us can attend to the child without waiting for one another.

Hello everyone, I’m currently still in the asylum process in Germany. I recently submitted an Umverteilungsantrag because I received and signed an Ausbildungsvertrag as an Anlagenmechaniker in RLP. The company also provided me with a strong supporting letter, confirming they want to train me and help me get settled.

However, the receiving Ausländerbehörde informed me in a letter that they plan to reject the application, saying that starting an Ausbildung is not a valid reason for approving a transfer. But they gave me the opportunity to respond and explain my situation once again before making a final decision.

This Ausbildung is a serious opportunity for me to integrate, learn a profession, and build a future in Germany. In my current location, I’ve searched for months and haven’t been able to find any suitable Ausbildung positions. The company urgently needs trainees, and they’re ready to support me throughout the process.

I also want to add that I have an uncle living near Pottum, and he has offered me free accommodation if I move. This would make it easier for me to settle, reduce my financial burden, and allow me to focus fully on my Ausbildung.

Also, I saw on the official website of the Bezirksregierung Arnsberg (NRW) that an Ausbildung is considered a valid reason for approving an Umverteilung – especially when there is already a signed contract. That makes me confused about why it’s being rejected in my case.

I have two main questions: 1. What should I write in my response to the Ausländerbehörde to improve my chances of approval? 2. If the application is finally rejected, is there any other type of application or legal way to still be allowed to move and start the Ausbildung?

Sehr geehrtes Wefugee-Team,

meine Frau und ich sind verheiratet; die Ehe wurde auch in Deutschland anerkannt. Im August 2019 haben wir Asyl beantragt.
Beide haben wir erfolgreich eine Ausbildung absolviert – diese wurde aufgrund guter Leistungen von drei auf zweieinhalb Jahre verkürzt.

Nach der Ausbildung haben wir eine Aufenthaltserlaubnis gemäß § 25b Absatz 1 Satz 1 AufenthG erhalten.
Diese Aufenthaltserlaubnis gilt seit dem 09.04.2024.

Wir haben bis jetzt 4 Jahre durchgehend Beiträge in die Rentenversicherung gezahlt und verfügen über ein telc B1-Zertifikat.

Meine Fragen:

Besteht die Möglichkeit, bereits vor Ablauf der vollen 60 Monate Rentenversicherungszeit eine Niederlassungserlaubnis zu beantragen, z. B. über einen Wechsel in § 18a AufenthG (Fachkraft mit Ausbildung)?

Wenn nicht, ab wann könnten wir frühestens einen Antrag auf Einbürgerung stellen?

Dürfen wir mit dem aktuellen Aufenthaltstitel nach § 25b Abs. 1 S. 1 AufenthG in unser Heimatland reisen, oder würde dies zu Problemen führen?

I applied for aufenthaltsgesetz 16g on February 22. But till date I haven’t gotten a response. They messaged me beginning of March to request more documents and ask questions which i submitted. I messaged them in April the week of Easter to ask them how much longer should I wait and they said I should be patient they are still processing. But now it’s end of May and they still haven’t gotten back to me. Is it suppose to take this long? Or what is happening?

The foreigners office has provided me an appointment for issuance of a permanent residence permit on 27th of may and has asked me to bring a service charge of 67 euro. If I am not wrong ,then it cost more than the required amount stated. Did I understand wrong? Or am I stupid? I’m an asylum seeker currently living in Bavaria (Bayern) and I’m in the process of applying for an apprenticeship in the heating and sanitary sector. I recently received an offer from a company located in Rheinland-Pfalz, but I’m running into some issues that I hope you can help me with.

Here’s the situation:

The company has agreed to take me on as an apprentice, but they have refused to give me a signed copy of the apprenticeship contract for now.
They told me they will only send me the signed contract after I receive permission from the Ausländerbehörde to move to Rhineland-Pfalz.
They also said that a worker from the Handwerkskammer will handle my application and the paperwork with the authorities, which is why they don’t want to give me the contract yet.

From my understanding, the company should normally give me a signed contract first, especially because I need it to apply for permission at the Ausländerbehörde.

I’m worried because if my application is denied by the Ausländerbehörde, the company might back out and leave me without any security or proof of the offer.

My questions:

Is this behavior normal when applying for an apprenticeship in Germany, especially for asylum seekers?
Shouldn’t I already have a copy of the signed contract before applying for permission?
What steps can I take now to protect myself if the company decides to cancel everything?
Has anyone experienced something similar with the Handwerkskammer handling the application process?

I have friend of mine who is asylum seeker here in Germany, he is very dedicated on Christian evangelical activities especially for Sunday schools ( kids ) and teenagers. He is now volunteering in one German international evangelical organization in Bonn and he has Also related project that he **** forward to implement. He was doing these activities during his entire life, teaching kids and teenagers about good moral life which is based on Christianity and Bible. He needs your advices:
1. How can he register his NGO? Can asylum seeker register an NGO in Germany?
2. Can you advise where can he apply for funds to support his NGO activities ?
3. Can volunteering in that German evangelical organization and help him to get residence permit and quit asylum application process because his activities require him to travel and move frequently unfortunately he can do that because his asylum application is still ongoing.

Hallo! Ich habe gerade eine schwierige Situation mit meinem Aufenthaltsrecht und ich habe jetzt eine Duldung. Ich studiere hier in Berlin an einem Universität und wohne in einer WG. Vor ein paar Tagen habe ich ein Angebot mit Studentenwohnheim von Studierendenwerk bekommen und würde dies sehr gern annehmen. In meiner Passersatz steht, dass Wohnsitznahme im Land Berlin erforderlich ist. Meine Frage ist, ob ich das Recht habe, in eine andere Wohnung in Berlin umzuziehen, ohne einen Antrag auf Erlaubnis beim LEA zu stellen, da die Bearbeitung dieses Antrags sehr lange dauern kann, ich aber in den nächsten Tagen eine Entscheidung treffen muss. Und wenn ja, wie funktioniert dann die Anmeldung, wenn ich keinen Reisepass bei mir habe?
